Question about selling Mini-14 folding stock at online auctions

I have a brand new still in box stainless steel stock for a Mini 14 that I want to sell at an online auction. Yes, it was bought before the ban. What do I need to know to stay legal? I suppose there is no way that I should ship it to CA? What other states or municipalities should I not ship it to?

I'm not sure but I would put something in the auction that says that the buyer is responsible to make sure that it is legal in their location. Lots of disclaimers in catalogs and on other auctions to give you an idea of the wording.

It's a part, not a firearm. Sell it to CA or anywhere else in the US.

You might add that it's the buyer's responsibility to ensure legality prior to installation.

The folding stock by itself is not restricted under the '94 AW ban. You can sell it to anyone you want. You could call it a folding walking cane if you wanted. The buyer is the one that has to worry about the ban.

ATF interprets the ban as saying that a firearm that was not a completely assembed "assault weapon" at the time the ban went into effect cannot now be converted into a AW configuration. This means that a person cannot add a folding stock to a Mini-14 that was not already configured as a AW in '94, even if that gun was manufactured prior to '94.

The buyer's other problem is that ATF considers a person in possession of the parts to assemble an AW, even if they are not actually assembled into an AW, as being in possession of a postban AW.
