A 77-year-old man was defending his home when he fired a handgun and killed an intruder as the two men struggled early Wednesday, Escambia County sheriff's deputies said.

Deputies had not yet identified the dead man Wednesday night.

James Workman has been residing with his wife, Kathryn, in a trailer outside their Hurricane Ivan-damaged home on Seaglades Drive off Gulf Beach Highway.

Workman, an oil industry retiree, told deputies he confronted the man, who entered his yard about 2:20 a.m. Wednesday. After the man refused to leave, Workman tried to warn him away by firing a shot into the ground, deputies said.

But, Workman told deputies, the intruder then walked around a portable POD storage unit and entered the trailer, where his wife was. Workman scurried into the trailer, and the intruder grabbed him. As they struggled, Workman shot the man several times with a .38-caliber handgun.

The State Attorney's Office is reviewing the case and will decide whether to declare the shooting justified or file charges, Assistant State Attorney David Rimmer said. The dead man's name is not being disclosed pending positive identification and notification of any family members, officials said.

Rimmer will review reports from Sheriff's Office investigators as well as the autopsy and toxicology report from the suspect, he said.

Workman, whose hand was bandaged, declined to talk about the incident Wednesday afternoon as he sat with neighbors Bill McLendon and Bobby Henshaw.

"The deputies responded very quickly, and they were very professional," Workman said. "They need to be commended."

Henshaw said he was sleeping when he heard Kathryn Workman's cries of distress.

"I heard a scream, and I thought it was a bird or something," Henshaw said.

As another friend walked up to embrace him Wednesday, James Workman quietly told him, "I had no choice."

The shooting happened just 100 feet from an unusual but unrelated incident on Oct. 8, when neighbor Read Nichols fired his .22-caliber rifle to fend off a growling, machete-wielding man later identified as Luke Gambill.

Deputies had to subdue Gambill with a bean bag projectile and later a Taser.

Sounds like my kind of neighborhood. I hope all turns out well for the elderly couple.

What kind of an idiot - unarmed it seems - doesn't retreat from an armed home owner? Darwin Award nominee it seems.

I wonder what percentage of violent crimes involve excessive use of alcohol, drugs, or both.

They'll probably try to get him on attempted murder for the warning shot.

Not a real smart thing to do, but I hope it turns out well for him.
