Not fake. I saw this some time ago and aparently the cop beat the daylights out of the kid and both kids got arrested. At least that's what I hear.

That must be a new crime. I only saw one assault in that video.
Surely none of you are going to imply that a middle finger is in some way threatening or that flipping anyone off is deserving of arrest or a fine, let alone a beating?
Anyone have a link to what actually happened with that case?
And some nifty 1st amendment jurisprudence for all the jackboots who think that was justified. Note that both of these cases involve people being much more rude to the cops than the kid was:
Commonwealth of PA v. Fenton, 2000
The Court observed that there are times when using a base term for sex may be intended to express disrespect for someone and to offend that person, yet not amount to offensive communication that appeals to the prurient interest. The court stated: "It would be a rare person who would be 'turned on' by the display of a middle finger or the language it represents . . .."
CITY BISMARCK ND v. THOMAS SCHOPPERT, 1991
On April 1, 1989, Schoppert (an attorney!) approached a police car in which a police officer and volunteer police chaplain were sitting. As he walked past the car from its front to its back, Schoppert gestured with his middle finger and said, "????ing, bitching cop." The cop followed Schoppert and attempted to talk to him through her car window. Three times she asked Schoppert what was the matter and three times he replied, "???? you." He was then arrested.
The court said, "The First Amendment protects a significant amount of verbal criticism and challenge directed at police officers. Speech is often provocative and challenging . . .. [But it] is nevertheless protected against censorship or punishment, unless shown likely to produce a clear and present danger of a serious substantive evil that rises far above public inconvenience, annoyance, or unrest." - INNOCENT!

Some places distinguish between assault and battery, but that's neither here nor there.
If it was real, then it should have been an episode of Jackass, lol up there with the guy getting hit by a firehose.

I see an assault here, but it was from the guy BEATING THE KID WITH A KNIGHTSTICK!
A middle finger does not give me the right to use LETHAL force (a knightstick can and does kill.) P95carry, would you have shot him?

What we don't know is exactly what he said to the cop. Certain words like, "I'm gonna...." after the way he approached the cop and was physically agressive may have been reasonably perceived as threatening. He didn't just walk by and casually flip the bird. He had just come from the passenger seat of a parked car. Who knows what his consiprator in the car was going to do? The cop did not whack him as he was leaving. The guy was jumping in his face. If that happened to me, I might think that the guy was high and/or waving his hands around to distract me while he (or his partner in the car) pulled a gun out of his pants to kill or kidnapp me.
I don't think this is so clear cut at all.

The cop did not whack him as he was leaving.
It actually looks fake, however I did see the kid immediately retreat before the first blow struck, and the officer followed him and continued beating.
Same as following a perp out of your house and down the street whilst shooting at him.
