Umm, got that backwards in the subject. What they did was fail to respond to his case against the government. Doh!

The story makes quite a leap in assuming the govt. has conceded all the points asserted by petitioners; as interesting as they are. They (the govt.) could just as easily be supremely confident that the judge will dismiss the motion, without having to waste the effort to respond...
