LYNN, Mass. --A woman found dead on her couch may have been killed when a bullet was shot through her ceiling, police said.

Kathryn Lally, 37, was found by her mother Sunday morning, on the couch where she was believed to have been watching a movie the night before, according to a police report obtained by The Daily Item of Lynn.

Eight people in the apartment above Lally's have been arrested on unrelated drug and weapons charges, and were to be arraigned Monday in Lynn District Court.

A hole was discovered in the ceiling of Lally's apartment, which was consistent with a bullet hole, the police report said. Smatterings of ceiling tile also were found on the coffee table near the couch.

Officers concluded that a bullet fired from the apartment above may have struck Lally, the report said.

Steve O'Connell, a spokesman for the Essex County district attorney, said Lally's body has been taken to the medical examiner's office for evaluation.

After a search of the apartment on the floor above where Lally was found, police arrested the eight people and charged them with marijuana possession. Four of the eight also were charged with unlawful possession of a firearm and unlawful possession of ammunition.

Arrested the drug charge were: Joseph Castillo, 22; Terrence Giambusso, 19; Elease Davis, 21, and Melinda Lozzi, 22. Facing the drug and weapons charges were: Bobby Boyd, 23, of Lynn; Lorenzo Davis, 22, of Lynn; Christopher Hodgon, 19, of Lynn, and Jarmahl L. Sutson, 21, of Lynn.

O'Connell would not confirm if those arrested were suspects or related to the investigation into Lally's death."


The local news here is saying that somehow he accidentially fired the weapon while trying to clear a round in the chamber of his semi auto. I guess he was to high to remember to rack the slide FIRST before pulling the trigger.

oh great. a total idiot not only gives anti gunners another huge p[ice of turd to lob, but this Jerk also gave the anti weed people more ammo as well.

people this stupid should not live. oh this is terrbile news, and so so horrible for the poor lady and her family/friends.

and of course it will be blamed on the weed and the existence of the gun-
instead of the reality- this kid was an IDIOT.

i mean how many of you have discharged a weapon this way???

what kind of idiot has an unneeded round in the chamber?

The best of us can, and probably will, have an ND. The people in the apartment above were idiots. Not only was at least one person NEGLIGENT, they didn't own up to their actions by the sound of it. A mature person would have checked on the person downstairs, and probably called the police to check in on them if they didn't answer. If they had done that, I'm willing to bet that there would have been no arrests of the others upstairs. If a person is killed by a ND, that's called manslaughter. By not reporting the incident, all persons present were accessory to the crime.

This is all based on my understanding of the story, and as we know, the media ALWAYS gets it right, and ALWAYS tells the whole story. And everyone knows I ALWAYS comprehend exactly what is written, especially when skimming the story...

If the idiot was doped up, he probably forgot there was an apartment below. He probably proceeded on the assumption that pointing it at the floor would be safe ... with tragic consequences.

Assuming that the owner of the gun didn't have a permit, this is actually another argument FOR less restrictions on firearms. If we were back in a period when firearms safety was taught in schools, there's a degree of probability that such incidents would be far fewer in number. As it is, guns today are like condoms were when I was a kid ... something dark and secret, and available only on the black market, so the only way you learned anything about them was rumor, and rumor is usually not a reliable source for information.

In Mass it is illegal to even posses reloading components (yup, even brass or bullets) without a FID, Class B or Class A LTC. :barf:

I could find the statute but I'm too lazy right now.

Did they have unlawful trigger fingers too?

What if you lived in a fairly gun freindly state and you had a ND while being perfectly sober and legal, and say this ND resulted in the death of someone.
Would it be considered a negligent homicide? What are the penalties for something like that?

Bravo, it kinda depends. If you were being reasonably careful, it would probably be just an unfortunate accident. You'd be subject to varying shades of manslaughter or negligent homicide if you weren't careful.

It's easy not to have an ND: Don't be negligent.

That's like saying most airplane pilots will crash their plane: It's jsut not true. Safety is no accident.

A big lesson for the rest of us to take away from this is that, in an apartment building, there may not be any "safe direction." If you don't KNOW exactly what is beyond what you are pointing at -- don't pull the trigger.

A 5 gallon bucket of sand would, if used properly, have saved her life. Maybe there should be a law mandating... :scrutiny: No, let's not go there.

Our lovely state also classifies Pepper Spray as ammunition. So you must get licensed to carry any spray for self defense.
