Florida ccw question?

I was wondering something about no carry zones in Florida. I attend night school for classes to get my GED and wasen't sure if I can carry or not? I know schools such as elementry,middle and high school are off limits. But are night campuses included in this? Just to be safe i've only carried my tactical folding knife and 15%pepper spray till I know for sure.

I park in the well lit section of the parking lot close to the doors where theres usualy alot of people at the end of the night due to classes getting let out. I figure I should be ok with my above mentioned set up if my handgun isn't allowed. What can be done to someone in Florida for carrying in a no carry zone? can you be arrested,face jail,the loss of your gun and permit? Also is arrest manditory of up to the responding officer?

I'am not talking about being "made" I have the motto concealed means concealed. i'am saying lord forbid you ever had to use it. Speaking of which do you guys think my above mentioned set up for personal defense is a sound one? I.E. the knife and pepper spray? Thanks for any input guys.

Yes, night campuses are included. You have to leave your firearm in your vehicle while attending class. Not sure what the penalty is for carrying in a prohibited area.

I take it that "having to use it" means that you would be in fear for your life. If you are, indeed, in a situation where you are in fear of losing your life, then I would think that legal considerations would become secondary to self-preservation.

Looks like the choice would be " Should I save my own life and be prosecuted, or should I avoid prosecution by being killed?"

I am in the same dilema. I do what you do, carry a folder and leave the gun in the car where it IS legal to keep it. Don't know why there is a need to prevent carry at schools by law-abiding adults, especially colleges. Seems silly. We can carry just about everywhere else. I guess if there was trouble the campus security at BCC would handle it :what: (Yeah, right).

At USF, we have our very own state recognized/trained police department. It's really funny, they are a real PD just like Tampa PD and the Hillsborough County Sherrifs. Kids think they can drive however they want on campus because they are just "security gaurds" They learn the first time they are pulled over. :p

The only problem is, I'm in engineering. I hate to sound racist, but there are nothing but Arab students and teachers in Engineering. Every semester I have at LEAST one professor who barely speaks english. Like I said, I'm not trying to stereotype, but these same kids hold Muslim rallies, Kuran awareness rallies, etc. Hell, one of OUR professors, Al Arian, was arrested for suposedly being the North American leader of Palastinian Islamic Jihad!!!!!!! What happens if one of them gets pissy and wants to cause a scene??? There are NEVER police officers on the engineering side. They hang out on the stupid side of the campus (arts & sciences) and watch all the incredibly hot woman all day.

From what I understand, carrying in a prohibited area is a second-degree misdemeaner. You would have to look up the statutes to see what penalties apply, but usually it means a possible jail term of less than a year and/or a fine. I have no idea what it would do for your CCW.

A second degree misdemeanor in FL is punishable by a sentence no greater than 60 days (775.082). The fine shall not exceed $500 (775.083).

In regards to your CCW, subsection 7 of 775.082 states that:

(7) This section does not deprive the court of any authority conferred by law to decree a forfeiture of property, suspend or cancel a license, remove a person from office, or impose any other civil penalty. Such a judgment or order may be included in the sentence.

Meaning that the judge, at his discretion, may revoke or cancel your CCW.

In Fla. not only is it illegal to carry a firearm in the school but it is also illegal to have it on school property, which includes the parking lot.

The private conveyance provision is new and a surprise to me. I'll have to check my copy of the law. I seem to remember someone on a forum grumbling that in order to pick up his children, he had to stay on the public road. ---- I stand corrected, Florida Statute 790.115 (2) (a) 3 does permit carrying in a vehicle.
