For years the Legal Eagles have been saying that we can not use the National Guard or the military to guard our borders.
So,is it legal to use them in N.O. or other places as is being done right now?
Was it legal to use them in Waco? :banghead:

Do not want to get into all the fine print, but you are looking at 2 different activities. To further complicate the issue, some of the NG assigned to disaster relief/recovery has been federalized and some have not.

Is it legal to use them in NO/LA/AL/MS? Short answer is: Yes.

The National Guard technically belongs to the state and are under the control of the governor. Disasters is one of the reasons states maintain NG units. When they get sent to places like Iraq, they are placed on active duty under the DoD and are considered the same as any other federal military unit.
