Well, the hearing is over. A lot of ruminating, but Jeff Sessions (good guy) said it best. The Constitution doesn't say "public purpose". It says "public use".
Kelo was an activist decision. There will be some legislation in response, but I don't really hear the outcry. Obviously, the Judiciary Committee is very distracted right now. I expect the floor debate on any related bills would be pretty interesting.
It is frustrating that they don't want to confront the Court more directly. None of them is sure they have any authority.
O'Connor added a comment recently when she referred to the ruling as "scary". What is "scary" in my opinion is the Court, especially Stevens, not so much the implications of the ruling.
