old road rage case

When Colorado first allowed people to carry, one road rager got out of his vehicle and began beating the man in the car behind him through the open window. After the victim feared death, he shot his asailant once who later died.

Some said it is just the "wild west" they warned about and some said the law worked perfectly, as planned.

I never saw the outcome. Anyone remember this case?

IIRC the victim, Gordon Hale, was getting beat on by a younger, bigger, stronger man, Kenny Tavai. The former shot the latter. Witnesses only differed in the number of blows to the head Mr. Hale absorbed before shooting Tavai.

The Dallas DA charged Hale with murder, but the grand jury refused to indict.

Why blame the Concealed Carry law? If the idiot, Kenny Tavai hadn't assaulted someone, then he would still be alive. I hate it when they make a bully out to be a victim. He only fired one shot. To me, that means that he fired until the threat was no longer there. Worse yet, think of what would have happened had Gordon Hale not been carrying: he could have been killed. So the Concealed Carry Law works; it saved a life.

Kenny Tavai would be alive, and Gordon Hale would quite possibly be dead or permanently disabled from the blows to the head. Shows what type of person the NY Times prefers to keep around. :barf:

Now really. This statement is not quite correct. One man did die, but an INNOCENT MAN is alive.:D

If I remember correctly, a few days after the governor of Louisana made it legal to shoot carjackers, a lady took one out for good.

Dunno if it was the same case, but in my CCW class they included a video about a very similar case. That guy did go to trial for murder, but was acquitted by the jury. However he also was sued by the kid's family and lost what little he had left after paying off his lawyers.

In that case, the old guy apparently cut off the kid, presumably not on purpose, or they had a near miss of some sort. The kid flipped his lid and started tailgating, honking, etc. Old guy takes an exit and signals the kid to follow. Old guy stops off the side of the off ramp, supposedly so he can verbally berate the kid for the road rage. Kid jumps out of his car, runs to the old guys car before he can get out and punches the old guy at least once, several times according to the old guy, after a verbal exchange. He walks away, then turns around to come back. As he approaches the car window the old guy takes his hog leg and fires a shot that severs a main artery in the shoulder region causing the kid to bleed to death.

For your information my brother was not an idiot, you should get your facts right and not make assumption. Ken was 5:10 and weighed 200lbs, Hale was 6 feet tall. Did you ever ask why Hale came back and pursued Ken? I think because the power of having a gun got to his head. Gun are not the problem, it's the hands that it falls in.

Hale was not an innocent man, he came back after the fender bender and blocked my brothers truck. Get your facts right and thank God it wasn't your son, brother or father.

Correction, our family never sued because my mother said, "Vengeance belongs to God, we just forgive the man and pray for him." Your version of the story was correct he was provoked by Hale and I think Hale had strength to do it because he knew he had a gun he could use and possibly get away with it. What people in this prejudiced state of Texas would convict a white man versus a Samoan (US Citizen) who looks like a Mexican. To them it's one less illegal in their State.

I doubted very much if Hale would be crippled, he was 6+ feet tall and my brother was 5:10, I don't see the logic.

According to the old news reports, Hale was the one driving the truck.
