My cousin, a VA resident, has made a nice offer on one of my Yugo SKSs, and I would like to take him up on it. He doesnt have a C&R or FFL, do I need to ship it to his dealer (or wait for him to get his C&R) before I can complete the deal? I am a Maryland resident with a C&R, and the Yugo was purchased using my C&R.
I thought I heard something about VA residents not being able to buy from dealers outside their state, but was not sure if that applied to C&R eligible guns or not.

You may not SHIP a firearm to an unlicensed person in another state, either personally or using your C&R. You must ship it to a 01-FFL to transfer to the buyer or wait until the buyer get's his 03-FFL. (178.30)

You MAY sell the rifle or shotgun to an out of state unlicensed person if he physically comes to your licensed premises (house for a C&R transfer) and the rifle or shotgun is legal at both the point of sale and the buyers residence. (178.29(b))

HK: I'm well aware of the shipping requirements, my question relates specifically to VA law, not federal, as I thought they had their own little background check program set up instead of NICS, thus requiring all guns go through an in-state FFL.

59.1-148.1. Purchase of firearms in contiguous state. Any resident of the Commonwealth of Virginia, including a corporation or other business entity maintaining a place of business in this Commonwealth, who may lawfully purchase and receive delivery of a rifle or shotgun in this Commonwealth, may purchase a rifle or shotgun in a contiguous state and transport or receive the same into the Commonwealth of Virginia provided the sale meets the lawful requirements of each such state, meets all lawful requirements of any federal statute, and is made by a licensed importer, licensed manufacturer, licensed dealer, or licensed collector.

However in a similar situation where the distance between you two is much greater I would wait for him to get his C&R (if he planned on it anyway). If he didn't it would involve extra fees to ship it to a FFL near him and pay for the transfer (probably for near the same amount as getting his own C&R :rolleyes: ).

My cousin lives right across the nearest bridge in VA, so he and I meet up a lot. Distance is definitely not a problem, he's one of my favorite shooting buddies.

OK, folks, what about a reverse of this? I'm a new poster at THR, and I, a Virginia resident, listed a Garand from DCM for sale at Auction Arms. I've been approached online by a Maryland C&R 03 to buy it. From what I've read both here and at mdshooters.com/org, I can do a face to face (FTF) transfer in Virginia? I should get a copy of his C&R (and driver's license, too?) -- then what? The rifle was never recorded in my C&R because purchased before I got my 03 license. Ah, Virginia law: I received the Garand on my doorstep from DCM without going through any dealer!

Please let me know your informed opinions.

As a private individual, I'd suggest you steer clear of shipping directly to a C&R ffl. It's too much of a headache for you. Ship it to his local FFL.

I've done FTF transfers of handguns in Virginia on three occasions without problem, but I want to stay on the good side of the law -- especially in Maryland whose state govt. apparently guns only in the hands of cops and VIPs. Maybe I should have posted this question on the mdshooters.org site, but I thought THR was more widely read. I'm guessing it might be better to have the Maryland buyer meet me in Virginia... Thoughts?

Why should it be any more headache than shipping it to an FFL dealer? The only difference is that you can't verify the license online. And unlike many dealers, most C&R's don't have a problem receiving from an individual.

Someone insisting they ship a C&R to a dealer instead of using my license would result in an immediate "no sale".

Its the Federal Firearms Licensing Center and they would be happy to verify the authenticity of any license.
