Owning silencers in Florida?

I was a class I dealer some time ago, but I'm not up on the Class II & II laws.

Does anyone know the laws and application procedures for owning silencers in the state of Fla?

I'm no expert ..... but I'da thought the state would not matter ... as that is an ATF thing ... ain't it? You'd have to pay your $200 to get the paperwork to be able to legally own and use one.

Still amazes me that there is such a big deal on these damn things.

I started looking in on this before I moved out of Central FL. My thoughts were to eventually by a subgun, but silencers ought to be about the same. They're legal in FL, you just have to get a signoff from the top local LEO, county sheriff usually. Some are OK with it (Orange Cty was cool, Seminole was OK as long as no arrests ever), but I've heard some aren't quite down with it...I'd imagine aquiring one LEGALLY around Miami might present some issues.

Suggestion would be to find a Class III dealer as close as possible and check with them. There is/was one in Orlando near the jail, and University Gun & Pawn in Tampa used to come to all of the Orlando gunshows and seemed to have decnet equipment. I do not know any of their reputations, however, so keep your eyes open and the BS sensors on high.

I know State laws do matter, at least in CA.... Other States seem to live by the "Big Boy" rule. I've always thought a suppressed MP5 or similiar could be a practical HD firearm, just not here.......

No additional restrictions on title II stuff in Florida. (http://titleii.com/Bardwell/nfa_faq.txt) Search the page for "State NFA Restrictions".

Class III is OK in FL, normal Fed Paperwork apply (Form 4). Not sure where in SW FL your from but the store I work at does Class III Transfers. I think we still have a .45 Suppressor in stock for a USP Tactical/MK 23.

Drop me a line if you want more info on getting/transfering a Class III through the shop. I may be slow on responding the next few days as the I'll be at the NRA Convention and the Store is sponsoring the Springfield Speed Challange going on in conjunction with the Convention.

No problem in Florida. If you do happen to live where you cannot get the CLEO autograph, you can incorporate fairly easily and then acquire NFA items without the CLEO signature. Only downside is they have to be transfered if you close the corporation.

BTW, the Polk County Sheriff does sign Form 4s, if you happen to live in North SW Florida. :)

so if one is the president of a legally incorporated entity, what is the process to purchase a machine gun from a Class III dealer?

You find the NFA item you wish to buy and fill out ATF Form 4 just like everyone else. Since the item is owned by the corporation, you do not have to include the photo, CLEO or fingerprints. For the reason you want to acquire the NFA, you write "investment" instead of the normal "collector". Everything gets sent to ATF and when approved, you pick up the NFA item.

Most of us are gadget freaks, and I'd like to pick up a little silenced .22. I handled a Walther P-22 at the Shot Show that was pretty schweeet!

Thanks! How are things in "Imperial" Polk County? Winter Haven is my home town and I still have family up that way and make it up there a few times a year.

It'll be a few months before I come up with some cash, but I'll get back to you guys.
