SBR prosecution of former deputy - help?

A good friend who was a local deputy got fired. His boss siezed his personal patrol rifle out of the back of his cruiser and turned it over to the BATF. Turns out that he mounted a 14.5 inch barrel on his AR for his SWAT Team duties. (county too cheap to provide rifles) He wasn't aware that it was unlawful for him to posess a short barrel on a personally purchased rifle.

One wonders why they allowed him to use the rifle for over two years with no issues. :rolleyes:

Anyone got any sugggestions as to a good defense if this goes to trial? The rifle is being held as evidence by BATF and the U.S. attorney has yet to decide if they will seek an indictment.

Thoughts, suggestions or ideas?

since he was performing duties for the county with the rifle shouldn't the county be liable? vicarious liability or somethin like that, if they didn't tell him i don't think he should be charged
