(AP) KINGMAN, Ariz A man angry at firefighters who refused to rescue a cat from a tree was arrested after he started shooting at the fire crew, officials said.

Jeffrey Cullen, 58, was charged with four felony counts of aggravated assault with a deadly weapon, Mohave County Sheriff's spokeswoman Trish Carter said.

A three-person fire crew went to Cullen's home Thursday when he reported a tree fire, but found no blaze, Hualapai Valley Fire Department spokeswoman Sandy Edwards said.

Instead, Cullen told firefighters he wanted a cat rescued from his tree and knew they would only respond to a fire call, Edwards said. A battalion chief told Cullen to call animal control or wait for the cat to get hungry and come down.

Cullen apparently didn't like the response, Edwards said.

"He went back into the house, got a small black revolver and came outside shooting," she said.

The firefighters and a 12-year-old boy who had come to see the fire truck ran for their lives, Edwards said. No one was injured.

Deputies arrested Cullen after a brief standoff and struggle.

Don't know about there, but around here it's been a long time since firemen would help with cats in trees.

In all my days I have never seen a Cat Skeleton in a tree.

They come down when they want to. :)

Animal rights lunatic.
When they have their rallies sometimes I think their signs should say, "Save only the cute animals! The ugly ones we're not too concerned with.".

And who was it that said that everybody loves firefighters...? ;)

You know, sometimes I worry a little about our safety from people as well as from fire :uhoh: A couple month's ago, we responded to a wildfire on a local landowner's property. He was at the scene already, and proceeded to scream and yell at us about how he wanted us to fight the fire - while we proceeded to follow procedures and begin attacking it in a safe manner. Fortunately, it all worked out well and the guy finally calmed down.

Most cats will come down given time. They are a bit scared at first, but once the hunger/thirst starts to set in, they will take the plunge.

maybe they should have set fire to the tree and then rescued the cat and then he would have been happy

I do "animal rescues" much more than I would like.

It normally involves scratching and urination. Not to mention the howling of both the rescued, and the rescuer.

Cats will come down the tree (headfirst, believe it or not), before they let you catch them.

I have once attempted to "rescue" a cat from a apartment roof. 25 -30 feet above the ground. The damn thing jumped, spread flat like a skydiver and hit the ground.

Made a big 'swat' noise. It ran off before I could be astonshed.

As much as I hate your cat,

I will risk injury to me , to save you cat from further inconvenience to you both.

can someone tell me when shooting at people went from being attempted murder to assault?

Cases like this really annoy me. The prosecutors let some psycho off easy for absolutely no reason (i wouldn't be surprised if they plead down to a misdemeanor in this case). Then, when said psycho actually kills someone down the road, all the gun grabbers (which includes the same impotent prosecutors) blame guns and their law-abiding owners. :fire:

Hi nico,

It is a matter of semantics. You can't be charged with "attempting" any crime, because no crime occurred if it were only "attempted." Attempted murder has always been charged as aggravated assault. The "aggravated" usually involved the use of a weapon.

EDIT: Well, I must correct myself. Appears my info is way out of date, and they do in fact charge with "attempted" in AZ, if in fact it was attempted murder. I suspect that the reason for the ag assault in the OP is that the guy didn't actually hit any of the firefighters. (See Hawkmoon's explanation of intent for details in post#19).

Lunatic. I'm glad I didn't run over his cat with my car.

My cat used to have a peculiar relationship with a tree. The first time she got herself up there my friends and I went to some trouble to get her down. The second time, I coaxed her down. Prior to the third time my friend snapped this photo, and we said, "if you climb that damn tree again you're on your own!"

A couple of hours later she showed up at the door, uninjured, and that was the last time she went up.

He would have solved his problem much more effectively if he'd just shot the cat.

Not around here. Around here, attempted murder (generally construed as an intended murder in which the victim did not die) is charged as ... attempted murder. The distinction is intent. If the intention was to injure the victim, it's assault. If the intention was to kill the victim, it's attempted murder.

I think we should ban trees and other tall structures that a cat may climb. Do it for the kittens. :p

Perhaps I should have been more specific. In Arizona, attempted murder has always been charged as aggravated assault.

EDIT: I was wrong. I couldn't find it in the AZ statutes, but I asked the director of my college's police academy, and he set me straight. See my comments in post #15 above.

Yes, it was that episode with Vannah in a burka. Who could blame the guy?

TallPine:

I'm glad that worked out and he calmed down. As crazy as it sounds, I understand what that guy was going through. One night around 4:00 am my house caught on fire, we got out in time to watch the upstairs kitchen explode. The firefighters showed up quickly and then, following procedure I'm sure, assesed the situation and began to fight the fire properly - all I saw at the time was a bunch of guys taking their sweet time getting anything done. I know, they were doing the right thing but when your house is burning nobody is moving fast enough for you. It's pretty hard to contain your emotions (I didnt tell then what to do, but I was freaking out a bit) when all you own (and a couple of your cats) are burning up - in any case these guys from the Richmond City Fire dept. did a great job (even going in with tarps to cover electronics against water damage) and they retrieved my gun (at the time I only had the one) and some other important stuff for me.

I am not excusing the landowners behavior - just giving my perspective.

Stay safe and keep up the good work.

Joe

Edited to add - the guy with the cat in the tree who shot at the firefighters and the kid - they should lock him under the jail.

To put it even more in perspective... the incident I related occurred out in the middle of of about 30 sections (square miles) of land. It could have been bad though, and spread across his ranch to smaller acreages with homes a few miles away - which is why we called for aerial resources to assist ;)

Our training is to "anchor" the fireline at a safe point and then "flank and pinch" rather than just rushing to the head of the fire and trying to stop it head-on. A bunch of trees sure ain't worth dying for.

Worst part was that we are pretty sure some of the landowner's guests started the fire :uhoh:

The whole point is that any kind of emergency responder has to be alert to potential hazards from people as well as directly from the incident itself ;)
