The jury in a suit filed by the N.A.A.C.P against the gun industry was deadlocked yesterday in its third day of deliberations, it told a judge in federal court in Brooklyn. Jurors said they were at an impasse over whether the industry's marketing and distribution practices were specifically harmful to the N.A.A.C.P.'s members. The judge will make the final ruling, but the jury was empaneled to advise the judge in the suit, which claims that the industry could do much more to keep guns from being sold to criminals. The suit seeks a court order for more stringent monitoring of gun dealers by manufacturers and distributors. The judge, Jack B. Weinstein, sent the jury back to deliberate. Andy Newman (NYT)

specifically harmful to the N.A.A.C.P.'s members The most harmful thing to N.A.A.C.P.'s membership is the N.A.A.C.P. leadership that is involved in this suit.

Check out the earlier transcripts of the trial. The judge made up his small mind before the trial started.

Gun sales and marketing do about as much to damage blacks as Porsche sales and marketing does to whites. There is no doubt that a disproportionate number of white folks are killed or seriously injured in Porsches in the US compared to all other groups combined. That doesn't make Porsche at fault or racist. No doubt there is a bias, but that does not mean that the bias is the result of some underhanded activity.

I don't know about y'all, but I haven't seen much Mac 10 advertising anywhere, much less being stuff geared toward African Americans. In fact, I would be inclined to believe that African Americans are NOT a target consumer group based on those gun ads I do see. If there is prejudice, it is in not marketing to that group.

Contrary to the claim, gun makers can no more prevent guns from being sold to criminals (after being legally purchased by a non-criminal) then automakers can prevent stole cars ending up in the hands of criminals.

One thing to remember... this judge isn't widely known as "Reversible Jack" for nothing! :D
