I live in California and have a shotgun for sale. I have a C&R FFL. I need to ship the shotgun to the buyer's FFL. Must I have my (01) FFL ship the gun, or can I ship?

I'm not sure how california is but I've shipped rifles a few times and I just take it to the post office and send registered. It has to be recieved by a FFL though. Pistols have to be sent from a FFL and recieved by one.

Federal law allows you to mail the gun using overnight service.

You just have to make sure that state law allows you to. For example, here in NYC, the laws are very specific on how you can dispose of a weapon.

NYC has plenty of BS rules when it comes to disposing of guns, almost all of which have to do with registration.

If you live outside of NYC, you can ship a longarm directly to a dealer in another state. Since handguns are registered directly to the owner, you have to take them to an FFL to have them removed from your license, since the people who manage the pistol permits (NYPD, NCPD, County Sheriff, Clerk, etc.) need proof that the weapon was properly "disposed of".

This is one of my biggest gripes about NYS pistol registration laws. Why should I have to go to a dealer to have him ship a gun for me when I can do it myself? The only benefit I see is that a dealer can legally ship handguns via US Mail (by filing some form with the post office when they mail it). FWIW, I would rather send it Fedex and pay the extra cash to make sure it gets there without the box being opened.

Under federal law a non-licensee can ship any firearm to an FFL in any State.

BTW, an 01-FFL is dealer. An 03-FFL is C&R.

That's a federal law that you are referring to. Operation of State Law may make that impossible (like New York).

Those of us in the free-states may ship any firearm directly to an FFL without having to go 'through' one locally.

I would also make sure to contact the FFL and see what their procedures are. While there are specifc legal procedures in play, some FFLs have their own policy regarding transfers.

For example, I was attempting to have a long gun shipped to me, in NJ, from another state. Two dealers I spoke to said that they wouldn't accept ANY shipments from a non-FFL source. They had no specific LEGAL necessity to do so, but an overwhelming desire for CYA.
