In an affidavit, attorney Karen Stam said she has talked with several psychologists about Arguelles' behavior, and none of them believe his eating of feces could be a symptom of malingering, or faking a mental illness.
Corrections officials have said Arguelles is capable of behaving rationally, but acts out when someone is watching him.
Is it just me, or does that automatically make you think he's faking? :barf:

Why should insanity be a defense for murder? Seems to me, if you're messed up enough in the ol' cabesa to go around raping and killing little girls, the whole planet is better off without you.
For that matter, wouldn't you have to be crazy to rape and kill a little girl? If the insanity defense can be used to save someone from punishment, then anyone could plead insanity, it seems.
I say take him out back, have him dig a shallow grave, and put him down like you would a rabid dog. After all, a rabid dog is out of its mind, too. We don't offer to put them up in mental hospitals the rest of their lives, do we?

What about situations where the mental illness is temporary?
My kid brother was affected by hydrocephalus at age 14..."water on the brain". Basically excess spinal fluid backing up in his noggin...for a while there, he went violently nuts. The CAT scan pics showed very clearly that his brain was warped - LITERALLY. Once they had the plastic shunt tubing set up right, he was fine.
Any number of brain tumors can cause the same effects. Remove the tumor, dude is back to normal.

I am tired of the whole "Insanity" thing. A two year old girl was recently kidnapped by her Gandmother here in Utah. She took her up to Idaho and apparantly drowned her in the Snake River. They still haven't found the girl. The Grandmother "wasn't taking her medication". Imagine that. To top the whole thing off, this was not the first time she took the little girl. I can guarantee that the "Insanity" plea is coming here. Why do we put up with people like this? :cuss: :fire: :banghead:

While its not illegal to be insane,its still illegal to murder and rape.
Now whether you know its illegal or not shouldn't matter,we
as a society have decided that there will be punishment for the
crimes.
What good comes from having insane people around who don't
know that rape and murder are agin' the law?
I'm no shrink,but I don't think that an insane person can be
taught right from wrong.If they could they wouldn't be insane.
Just my thoughts.

My kid brother was affected by hydrocephalus at age 14..."water on the brain". My wife's friend's brother had this as well... at about 12 or 13. Was fine his entire life up until then, then he started doing seemingly malicious things: throwing drinks at family members, tripping his grandmother, hit one of his sisters hard enough that it completely knocked her out, when he body-slammed the smallest child, they started looking into why he was doing these things.
And, I don't mean to sound callous but if situations such as this or other temporary illnesses, the actions were still taken. I've honestly never understood why insanity or incompotence were excuses for commiting crimes. Ignorance of the law isn't a defense, I really don't see the difference (in how it relates to the law) between ignorance and incompotence.
Some extreme circumstances or conditions exist, but the lady that drove the wrong way down SR67 here in Indiana with 4 or 5 kinds in her minivan and ran into another minivan, unfortunately also filled with kids should NEVER BE ABLE TO LIVE AMONG SOCIETY AGAIN ! Period... end of story! Ol' crazy lady that nicely and neatly drowned each of her children then layed them on the bed... NEVER ALLOWED OUT OF THE CELL ! I don't care what sort of duress anyone is under, these options are never allowed or acceptable. And more importantly, they should never be allowed to be repeated again.

The insanity defense gets too much flak. It is only successful LESS THAN 1% of the time. The idea behind it is that someone actually had to make a concious choice to be guilty.

Arguelles, 41, is on Utah's death row for kidnapping, sexually abusing and murdering a woman and three teen-age girls while on parole in 1992 -- Margo Bond, 42; Stephanie Blundell, 13; Lisa Martinez, 16, and Tuesday Roberts, 14.
He should have been hanged a long time ago.

I still don't buy it. If I'm driving 63 MPH in a 55 zone because my car's speedometer is off, I still committed the crime without making a well thought out, informed decision. The crime is the crime. An accident is one thing. If a retarted child drops a hammer on a younger sibling, that's not murder. But hackin' somebody up after you repeatedly rape them... You only get one chance to do it. Death penalty! Did I just type that? Oops... I don't believe in the death penalty... So life sentence with no possibility of parole but Bubba can have a go at him couple times a day for the rest of his life. Crazy or not. Maybe he'll enjoy it if he's crazy. If not, well, he made the decision. :rolleyes:
