I just thought this was cool. We have heard about the trial before but here the ruling is the kid can actually be in the yearbooks with his sword. The ACLU helped fight for his right to retain the weapon in the picture (which was supposed to be a dress up pic).

PROVIDENCE, Rhode Island (AP) -- A school district that initially refused to publish a yearbook photo showing a senior dressed in chain mail and holding a sword has agreed to print it after all, lawyers for both sides said Monday.

School officials still believe their decision to ban Patrick Agin's photo was correct, but they face a $600,000 deficit and couldn't afford the legal fight, said the district's attorney, Stephen Robinson.

"It was strictly a cost-benefit analysis in the matter," he said.

Agin, 17, dressed in costume for his senior photo. He belongs to the Society for Creative Anachronism, a group of 35,000 dues-paying members who stage mock battles, learn arts like calligraphy and conduct demonstrations in shopping malls.

Portsmouth High officials claimed the photo violated the school's "zero-tolerance" policy for weapons. Agin and his mother sued with the help of the American Civil Liberties Union, saying the decision infringed his right to free speech.

The school district will also pay $2,000 in legal fees, the ACLU said.

The state education commissioner this month ordered the district to print the photo. School officials can regulate the yearbook's content, the commissioner said, but rules were being enforced unfairly, since past editions of the yearbook contain photos of toy guns, arrows and a knife. The school band's banner depicts a rifle-toting patriot.:D :D :D

If he's SCA, there's also the possibilty that the "sword" might just be a tape-wrapped rattan stick.

Either way, that school district could more profitably spend their time and energy elsewhere.

Don't fool yourself, the ACLU is all about free expression and has no regard for the status of the kid's sword.

"Zero tolerance" is an idiotic concept that should be fought by everyone. Adults should be running the schools, not simpering automatons who want to punt to an inflexible policy that treats a gangbanger packing heat and a kid who forgets a butterknife in his pack after scouting exactly the same.

The ACLU did side with gun owners in RI a number of years back. A case dealing with RI's "shall issue" status. Rare though.

Think they would have gotten involved had the kid been slinging a .22 target rifle or skeet shotgun? Didn't think so.

Actually, if the young man was part of a competitive target shooting team they'd have taken on the school just as readily. They've represented gun owners in the recent past (http://gritsforbreakfast.blogspot.com/2005/03/pack-your-pistola-and-hit-road.html). They're interest isn't in the "weapons", but in the other BOR implications.

Any time someone is afraid to post a picture of a prohibited item they need the pressure checked for the beach ball they're using for a head.
