Does it sunset Dec 31, 1994 (if a new one is not voted in) or at the begining of the year?

It sunsets 10 years after the original bill was signed, so it's 9/15/04, IIRC.

I know of at least one individual that has made an all-day appointment with his gunsmith's lathe and threading tools. Things will change immediately, there's no doubt about it, but I bet most manufacturers will still turn out 'post-ban' guns for those poor individuals in NY (who have a state version of the federal ban) and such.

One interesting (and totally scary) possible scenerio following the ban's death could be that on the 14th, everyone runs out threading barrels, adding folding stocks and buying up every cheap "LEO only" magazine they can find. Then our faithful representatives in government, pausing to let the elections pass, write/approve/sign a new AW ban that retroactively sets the ban date to 09/13/94 (and that is exactly what the existing new bills do).

What happens to all of these instantly illegal guns and accessories?

That's what they call an ex post facto law, specifically barred by the Constitution and case law from use by the Congress in criminal law contexts. The penalties for violating the AWB being criminal in nature, such a retro move would be unconstitutional and certainly face a Supreme Court willing to wade into that area of the law, even if they are reluctant to confront the meaning of the 2A directly.

I wouldn't lose any sleep over it. One of the reasons that the current AWB grandfathered preban rifles and mags, aside from the difficulty of getting them all or paying for a Fifth Amendment compensation package for them, is that facially unconstitutional retroactive criminalization isn't good for statute survivability during court reviews. The antis are evil, but they aren't completely stupid.

I'm not. :) I actually believe the AW will vanish next year. If a democrat beats Bush, they might succeed the following year in getting a new ban passed.

They may try, Russ. Before that happens we must all put all our energy into building the pro-RKBA organizations into political powerhouses and recruiting as many good, responsible gun owners to our side as possible. Write letters, introduce people to shooting, contribute money when you can.

Oh yeah, and when the ban expires, buy more guns. But I don't need to tell anyone here that!

Oops, I feel like a dip :cuss: , what a newbie mistake. 9/13 is my brother's birthday and I always remember the ban sunsetting the day after his 21st birthday, but I miscounted the years when making that post...
