O’Connor rescinds her emergency stay in descrambling case

Jan. 5 — The U.S. Supreme Court has bowed out of a long-running dispute over a DVD descrambling utility, dealing a preliminary defeat to Hollywood studios and electronics makers. Justice Sandra Day O’Connor placed a ruling by the California Supreme Court on hold last week, but rescinded her emergency stay on Friday.

To those not familiar with this case, a DVD descrambling code was posted on a web site by it's designer and was available for free to download. This allowed people to crack a DVD and save it to their computer hard drive.

What this latest news means is a strong reinforcement of the 1st amendment. It does appear that the desinger can be sued again if he posts this program again. It'll be interesting to see if he "spits in the dragon's eye" again...
