Can I sell (and ship directly to) some one who holds a FFL 03? Is it legal? It is not a C&R gun.

As has been said, NO! And if the buyer suggested it, I wouldn't deal with him at all.

The Curio and Relics 03 FFL is only good for Curios and Relics. If it's not on the BATF list, I wouldn't even consider it. Sounds like the guy is trying to pull a fast one. I recommend that you tell him to find an 01 FFL dealer, or cancel the sale and refund his money.

If the buyer lives in your state you can do it. Fed law only applies if you cross state lines.
State law will apply and some states restrict or prohibit private sales.
BTW- I don't believe that NJ recognizes the C&R at all and residents in NJ with one still have to transfer all guns through a 001 FFL (CA doesn't recognize the C&R for handguns purchases).
