Are there any states that permit open carry? If so where and what do you have to do to be able to carry in the open.

You can Open Carry in MN. All you need is a permit to carry. Gives you the option of open carry or concealed.

You can open carry in PA without any restrictions and without a permit. (Except for Philly I think) You only need a permit if you want to carry concealed or loaded handgun in your car.

Not a good idea. The attached link shows that while not forbidden by law you could wind up being arrested as a public nusiance.

Yes, you can open carry in AZ.
But what's the point?
It lets all the good guys know you're carrying a firearm.
It lets the bad guys know what side to attack you from.

SniperStraz, please re-read GA law. Georgiapacking.org has a lot of good info

O.C.G.A. § 16-11-128
Carrying pistol without license

(a) A person commits the offense of carrying a pistol without a license when he has or carries on or about his person, outside of his home, motor vehicle, or place of business, any pistol or revolver without having on his person a valid license issued by the judge of the probate court of the county in which he resides, provided that no permit shall be required for persons with a valid hunting or fishing license on their person or for persons not required by law to have hunting licenses who are engaged in legal hunting, fishing, or sport shooting when the persons have the permission of the owner of the land on which the activities are being conducted; provided, further, that the pistol or revolver, whenever loaded, shall be carried only in an open and fully exposed manner.

(b) Upon conviction of the offense of carrying a pistol without a license, a person shall be punished as follows:

(1) For the first offense, he shall be guilty of a misdemeanor; and

(2) For the second offense, and for any subsequent offense, he is guilty of a felony, and, upon conviction thereof, shall be imprisoned for not less than one year nor more than five years.

It's legal in Ohio but most are afraid to do so. Rumors that you will be picked up for "disturbing the peace", "inciting panic, etc. You could get hassled by police but they would probably have a hard time actually filing charges and sustaining them.

Some cities did have prohibitions on open carry but the recent state preemption is believed to have killed all of that although most people don't want to be the test case.

Actually, until March 14, open carry was required in Ohio if you had a CCW and were on a motorcycle. A few guys were pulled over for it, but AFAIK, no one was ever charged.

Open carry in Idaho is legal.

What do you have to do to open carry?

Well, you put your pistol in a holster and belt, strap it on around your waist and you're good to go.

VA is an open carry state. There are a handful of places where guns are prohibited (airport terminals, courthouses, churches, etc.), but that's it. The only thing you have to do is be legally entitled to own the gun.

Also in Virginia, there is no license or permit required or even available to OWN or OPEN CARRY a handgun. You do need a permit to carry concealed.

Can't forget VT and AK. In those states carrying is a right instead of a privilege like in the other 48 states. They have some silly outdated notion that it's guaranteed by the Constitution.

It's perfectly legal in Kentucky to carry openly. However, I have heard (read: I don't know if it is true) that before concealed licenses were available, those who open-carried in Louisville and Lexington were frequently harrassed by LEOs and some people were charged disturbing-type violations.

I have open-carried a couple of times. The problem that I noticed is that it really draws a lot of attention. I'd much rather blend in with the rest of the people so I usually go concealed.

In Indiana, you can carry either openly or concealed with a handgun permit. However, I never see anybody carry openly in public, and I suspect that to do so would draw a lot of negative attention.

I open carry in my truck and when I'm out in the boonies (no sheeple to scare).

Strangely, we have a pretty strong gun culture here and fairly lenient laws, but many people think the laws are very restrictive. I can't even recall how many times I've had to explain to people that it's perfectly legal for any adult to have a long gun without any kind of permit. Many people don't even realize you can carry a handgun.

Moron-"You have a handgun permit!?!?"
Me-"Yup"
Moron-"Does that mean you can, like, carry a handgun!?!?!"
Me-"Yup"
Moron-"Like, anywhere, not just in your house???"
Me-"Yeah, pretty much anywhere but schools and government buildings."

I can't even imagine the sheeple's reaction if I just walked around with one on my hip. :what: I wish I had the guts to try it, though.

I just went today to pick up my CCW. I live in Montgomery county. I would NOT advise OC in PA. The law may not be concrete, but the cops will sure harass you.

GRIZZ22,
Where did I say it was a good idea to open carry in PA? I was only answering the man's question. The link you posted outlining the pitfalls of open carry probably pertains to most open carry States. Just because it happens doesn't make it right but that's for another thread.

Oregon is open carry legal without a permit everywhere except a handful of cities (Portland and surrounding cities mostly, Eugene is legal, but very likely to result in "man with a gun calls" and having to TALK to the cops). With a CHL, Open carry is legal anywhere concealed carry is legal.

To the best of my knowledge, in Ohio, open carry went away when they passed the CCW law. There was that silly plain sight restriction on vehicle carry, though. I'm glad that's dead.

As others have said Virginia is an "Open Carry" state. I do so about 65% of the time. I live in the "95 corridor," call it Stafford county to Richmond. The only comments I've ever gotten where "Can I do that too?" and "What kind of sidearm is that?" Most people never glance at me.

Of course I am old, fat, balding white guy. About as nondescript as a person can get.

Arctic Assault,

You can open carry at 18. However, use some descretion on where and when. FPD might take some exception to yoots just tooling around with a pistol on their hip.

Both states I frequent the most allow open carry: PA and DE. I've open carried many-a-time in Delaware, sometimes because I couldn't be arsed to change clothes and more often because getting a permit to conceal there would require taking a day off of work to drive to Dover.

There was a guy who came into my store a lot who open carried all the time. He had a stainless Taurus PT92 with rosewood grips in a really flashy holster. I think it was intentional.

In Tennessee there is only a carry permit.

Been recommended to me to not open carry ever here. Reasons being, you are a target for some crook who may try to take it, some dumb fool may be illegally carrying, be on drugs and want to draw down on you. And most of all you do not want to get slammed to the ground or up against a wall by the sheriff or police so they can disarm you to find out if you legally may carry. It is like wearing a big target.

Basically open carry would be for the purpose of being at a public shooting range and your ease of placing the weapon somewhere while you reset targets or prepare to reload the weapon.

Been advised of this by two different carry permit teachers.

I totally agree with these two guys. If I am carrying it is my business only, not yours or anyone else's.

All geographic areas may differ some though as to attitude about carrying.

Indiana: Need LCH, open or concealed, in a car, to the range, hunting, etc.

LCH not needed to keep handgun in your home or place of business... I suppose that means you can carry it there too.:)

Open carry with no permit is legal in my adopted home state (AZ), as noted. As a practical matter, few if any people, at least in this large urban/suburban area, actually do it. I have a CCW and would only do it if everyone else were, e.g., a social gathering, if I worked in a gun shop, etc. I don't want any attention - good or bad - drawn to myself. And I would want a holster that provided at least some degree of external retention (e.g. a cop's duty holster) to prevent someone from just running up behind me and snatching my gun.

Open carry is legal in Louisiana as well. One of my friend's dad open carries everyday. In New Orleans East of all places. The police know it and do not give him a hassle, he has had to use it on a number of occasions, to warn and in self defense shooting.

Do you mean the concealed carry law?
OC is legal in laces that serve alcohol.
Concealed carry is NOT allowed in places that serve alcohol.

Don't come to MA. No Open Carry, and "printing" will possibly get you the charge of "brandishing".

North in NH - no permit for OC, $20 Non resident for CCW
Even better - Vermont (what do you mean, "permit")

Concealed carry is NOT allowed in places that serve alcohol.

I understand that. You are required by law to expose your weapon when visiting ABC establishments. I would like to see that silly law go away so they will allow CCW, provided you're not drunk off your ass. Just eating at Chili's is a PITA if you carry.

About the original post, OC legality can be a plus. It lets you 'print' without jail time, at least here in VA.

brickeyee
April 21, 2007, 02:46 PM
"...ABC establishments..."

Still not correct.
Every place in Virginia that sells alcohol has an ABC permit.
Every 7-11, every food store, every restaurant.
The criteria is for places that have a license for the on premisis consumption of alcohol.
You can even carry in a state ABC store, 7-11, Giant Food, Piggly Wiggly, Jamesway, etc.
