CA gun for NV sale

I bough an XD45 in California a few months ago, and have since moved to Nevada. I want to get rid of the XD because I've never fired it and don't want it anymore.

Do I need to worry about some agency in CA when I sell it? Do I need to fill out some weird interstate form? I will be going through a FFL so that change of ownership paperwork is legit and I'll have a paper trail.

Am I getting worked up over nothing, or is this a legitimate concern?

If you are now a legal resident of Nevada, you would not be breaking federal law to sell the firearm to another Nevada resident, face to face. I don't know about Nevada law, although I suspect it's the same. You could use it in trade with any licensed dealer; SFAIK, any licensed dealer in any other state.

Since handguns are registered in CA, if you want, you can file a No Longer in Possession form with the CA DOJ (http://caag.state.ca.us/firearms/forms/pdf/nlip.pdf). Filing it appears to be optional, and I don't know what they will do with it if you've already moved out of state.

I would NOT file the form in CA. Sell the gun in NV, why help CA in their effort to eliminate ALL guns. Screw their bookeeping attempts. You will not be breaking any laws.

Sell it here in NV and ********** can go get stuffed. If you live here you no
longer need to worry about Big Brother Jr. from Sac screwing with you.

I don't care what the golden shower state thinks. I was just wondering what, if any, legal repercussions I could be facing.

It is NIB and I am looking into local FFL dealers who would provide a paper trail.

I am new to this and don't want to loose my Rights.

You as a citizen of NV may sell a privately owned firearm to another citizen of NV with absolutely no legal ramifications. NV. law makes provisions for you to have a background check performed on potential buyers via the local sheriff but specifically states it is not a mandated requirement. I personally have bought and sold many weapons here FTF with no problems including firearms I acquired in Kali many years ago while in college. No problems.
Once you and your weapon left the state of Kali all those laws pertaining to it and your possession, sale or transfer of it ceased to be applicable and will only be an issue if you return to Kali with said firearm. Only NV laws now apply and there are essentially no NV state laws prohibiting the sale of private firearms between adults.

If you want a paper trail you can go through an FFL if you want but since they charge a transfer fee and may try to collect sales tax it could be a deal killer. You could always simply ask to see a valid DL or CHL and write down the info along with make model serial number of the weapon and keep it in your files. That is how I track private sales and have done it that way for decades.

I sold my CA bought handgun to a friend here in Reno.
Cash and a handshake, I threw in a holster and extra ammo too.

It's been a while since I drove out to your neck of the woods. You're near on a couple hunnert miles from here.

'Course, y'know, we could use this as the beginning of an excuse for all of us North of Tonopah to get together in Reno . . .

Thanks for all your help with my questions. It is the black service model with two ten round mags and a thirteen round mag. I paid about $550 for it and would like to recover around $450. I am willing to eat the FFL fee's for peace of mind and a paper trail.

A Northern Nevada shoot sounds like a lot of fun. I need to build my CA legal lowers.
