Can anybody explain the process of getting a ClassIII license to me?

Title kinda says it. But I want an MP5 and a M-16 A2 style rifle. AR, whatever but I want Safe Semi and burst.

For instance what price it is initially what kind of checks, paperwork, screening, renewal fee etc.

Call your nearest ATF office, and you'll get the best info.

However, tho, there's no such thing as a "class III license," unless you're talking about being a dealer or manufacturer (or a coupla other things - not applicable to most folks who wanna buy a buzzgun).

What there _is_ is a $200 tax stamp. Any Class III dealer who you'll buy from will know how to procede with this stuff.

$200 per transfer.

When you buy a suppressor, you add a $200 tax that the ATF (I think) gets.

You sell the suppressor to cousin Bob, cousin Bob pays a $200 tax to the ATF (or whomever.)

Then, when that cousin Bob sells the suppressor to your uncle........


Make sense?

(edit: Suppressor was just my example. The tax applies to anything Class III.)

The $200 is for the tax stamp as mentioned. The money really starts to flow when purchase price is discussed.

You mentioned that you want an MP5 or what passes for one nowadays (I want one, also). Those start about $9000 for a ready to use gun. A 'real' MP5 is hard to find and expensive to buy. Those start at about $12,000.

M16's are around $7,000.

That's what you need to train your trigger finger to do... I _fundamentally_ have a problem now with just crankin' on a trigger and holding it down...

Ok here goes,
First obtain a FFL
A 01 FFL is the most common
Then fill out a one page application for a SOT (special occupation tax)
$500 per year It runs from 1/7 to 6/30 every year and is not pro-rated
When your check is cashed your in business.
The SOT is easy the FFL is the hard part.
A good source of information is "The Machine Dealers Bible" you can get this through Small Arms Review.
This would be in my opinion the best $35 dollars you will spend if you are thinking of getting a SOT
By the way the FFL is $200 for three years,so the out of pocket cost the firat year is $700,but all you have to pay the 2nd year is the $500 for the SOT

Is a "SOT" required for the FFL? I've never herd of this before. Other than the book you mentioned, is there any other places (Online preferably) that talks about this. I've look through the ATF Sites before and I don't recall this.

What benefits does the SOT give you? I've been lookign into getting an FFL and the posible $500 /year may be a hinderence I was not aware of.

The SOT is an extra tax imposed if you desire to do business with certain weapons. For a business after 1988, they are Class I - Importer, Class II - Manufacturer and Class III - Dealer. 1 and 2 are $1000/yr and 3 is $500/yr.

Unless you are actually going to do business, this it not the way to acquire NFA weapons. You will need a business location, all state and local licenses, insurance, etc. It's going to cost a lot more than $500/yr. Even with all of this, you can't simply get machineguns. Any post-86 dealer sample will require a letter from a LEO/Gov agency requesting a demonstration of that weapon. If you give up your license, any post-86 dealer samples will have to be transferred to another dealer. You can retain any pre-86 samples or transferrable weapons you own, but you have to do a Form 4/$200 for each.

PA and TN both allow civilians to own NFA weapons. To buy an MP5 or M16, you simply find a dealer (Class III) to do the transfer. You fill out an ATF Form 4, get it signed by your CLEO, include fingerprints, photos and $200 check (one-time fee). When the paperwork is approved, you to pick up the machinegun.

Yeah, if one is already in business, a Class III dealer's license could be a cool way to do things. A little more freedom of operation (not as much paperwork to go to interstate-travel shoots), and you can buy, with a helpful PD at hand, dealer samples.

Now... Say you pick up a couple of post-86 samples. Then you go out of business.

Can you keep 'em?

thanks for that info. A friend and I may possibly become an FFL he spoke to the ATF and they mailed the paperwork like the next day. They did say that as long as we meet our state busines laws we hould be fine. I should have put the caveat in my first post that this will not be for Class III weapons at this point.

The Class III dealer (Type of FFL) you mentioned is for a dealer of Class III (type) weapons, correct? or is the SOT required to do business with any type of weapon?

Don't mean to beat a dead horse. But I'm hearing different .

The O1-FFL will let you become a firearms dealer, selling handguns, rifles and shotguns. If you wish to deal in machineguns, SBSs, SBRs, Supressors or AOWs, you need to also get the Class III SOT.

Yep. Criminals (that go uncaught) have it made. They can get cheap conversions to full auto with no taxes and no paperwork to deal with.
