Today when picking my 5yr old twins up from kindergarten, i happened to notice a gut that i do not know ,but see there every day putting his child in his car,and when he reached inside to fasten the seatbelt, there was hit s.o.b. with what looked like maybe a .38 sticking out from under his shirt. Now i have never seen or noticed this beforeand i am not sure if it bothers me or not ,however it is against the law to carry on school property in my state.Like i said i'm not sure how i feel about this. What would you do?

If he has a Texas CHL his carry is legal. Check your laws before accusing someone, the guy is one of us. He should not be flashing so you might want to mention to him that he might get in trouble for exposing. Here is the statute regarding carrying at a school.

ยง 46.03. Places Weapons Prohibited

(a) A person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a):

(1) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution;

(1) "Premises" has the meaning assigned by Section 46.035.

(3) "Premises" means a building or a portion of a building. The term does not include any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area.

Why would report him? Was there something about his behavior that made you think he was dangerous?

I don't care if someone else carries a gun. I expect "the public" to trust me with a gun. I trust others with them. Guns don't scare me. And guns under the control of of others don't scare me (unless they're OUT and POINTED at me). Who cares if he decided to take responsibility for his safety by being armed at a school, or if he forgot. I'll mind my own business unless I think someone is in danger.

OMG, why would you even THINK about reporting him?! For crying out loud, I LOVE how the liberals get to even our own kind :banghead: :cuss: :fire: .
Remember, that "law" is against the law. What now?

I don't feel it is my duty to assist in the enforcement of laws that are morally repugnant.
It would appear that this was not even the case.

And, yes, I do consider throwing someone in jail because they chose to carry a handgun while transporting their most valuable possession to be morally repugnant.

If he had the gun out and was pointing it around negligently, or threatening others with it, that would be one thing, but I cannot reconcile trying to get a father in trouble just because he carries a weapon on school property - regardless of laws.

Jeff OTMG, just curious, where does the playground fall under the definition of premises?

Viking6, I am not an attorney, but I would guess that a playground is generally considered off limits. The statute says, 'any grounds or building on which an activity sponsored by a school ' and I would guess that recess is an activity sponsored by the school. Any assembly of students whether formal, as an outdoor PE class might be, or informal, as recess time would be, is an activity sponsored by a school. The other reason I say this is that although the definition of 'premises' addresses only the structure as being permitted, all of the exclusions are areas in use by the public (driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area) specifically areas where a person might be expected to be to when picking up children from school. A playground is not the part of school grounds that would generally be open to the public.

Jeff OTMG, fair enough, thanks.

Even here in VT, we have a stupid exception to our universal ccw law for schools. One of my freinds had a brother who was under investigation for a robbery. The police knew my freind carried, so they just waited until he went to school (com college) and busted him for gun violation (he left it in his car) so they could use it as leverage against his bro. didn't work. neither convicted, but almost screwed up my freinds teaching carreer. Dumb law.

Graham,

I would follow what you have in your sig. Of course only if he were to pull his pistol and threaten someone with it.;)

About all I might do if I were rather close is let him know he was showing. I've done this before in public places and if I were showing I'd appreciate someone letting me know.

If I wasn't close enough to make casual contact then I would let it go and make a note to chat with him in the future. May be a future shooting partner or just a good guy to know. Common interest in self defense and firearms you know.:)
