WTK auto knife availibility

i know that auto knives are illegal in VA, but what is the law in MD and DC? is there a web site that has all of the info?

Auto knives are not illegal in Va, just illegal to carry for general use. You can own them and carry them to "Collector" club meetings or shows, but you cannot carry one around as a general utility knife or weapon.

why is it that i can't buy one at my local Benchmade dealer? all of the BM autos are marked LEO. do you know of anywhere i can pick one up?

I think it has to do with the federal ban on interstate autoknife sales to non-leo/military individuals.
You can usually find them at gunshows though.

AUTO's are not illegal to own in VA. You can also apply for an automatic knife license. I am a BM dealer so please e-mail me with any questions...

A license to carry an auto in Va.? Please send the statute requirements, I have never heard of a permit issued to carry autos beofre and would like to ramp up on the law there.

VA's automatic knife laws is the reason why VA won't acknowledge a lot of other State's CCW holder's. For instance, if you have your CCW in Florida you can carry an auto. VA's CCW won't allow for you to carry an auto so VA will never allow Floridians to carry in their State. Here is the statute:
Virginia - 18.2-308. Carrying concealed weapons... A. If any
person carries about his person, hidden from common
observation... (ii) any dirk, bowie knife, switchblade
knife, ballistic knife, razor... he shall be guilty of a
Class 1 misdemeanor, and such weapon shall be forfeited to
the Commonwealth... B. This section shall not apply to: 1.
Any person while in his own place of abode or the
curtilage thereof... 4. Any regularly enrolled member of a
weapons collecting organization who is at, or going to or
from, a bona fide weapons exhibition, provided that the
weapons are... securely wrapped while being transported.
5. Any person carrying such weapons between his place of
abode and a place of purchase or repair, provided the
weapons are.. securely wrapped while being transported...
D. Any person may apply in writing... for a two-year
permit to carry a specific type of concealed weapon...
- 18.2-309. Furnishing certain weapons to minors.--If any
person sell, barter, give or furnish... to any minor a...
dirk, switchblade knife or bowie knife... such person
shall be guilty of a Class 4 misdemeanor.
- 18.2-311. Prohibiting the selling or having in possession
blackjacks, etc. -- If any person sells or barters, or
exhibits for sale or for barter, or gives or furnishes,
or causes to be sold, bartered, given or furnished, or
has in his possession, or under his control, with the
intent of selling, bartering, giving or furnishing, any
blackjack, brass or metal knucks, any disc of whatever
configuration having at least two points or pointed
blades which is designed to be thrown or propelled and
which may be known as a throwing star or oriental dart,
switchblade knife, ballistic knife, or like weapons,
such person shall be guilty of a Class 4 misdemeanor.
The having in one's possession of any such weapon shall
be prima facie evidence, except in the case of a
conservator of the peace, of his intent to sell, barter,
give or furnish the same.
You will need to contact a local judge and tell them you want to apply for the right to carry an automatic knife. If you have your CCW, I would mention that as well...

How does one go about applying for such a permit? I have read that statute before, but assumed it was a holdover from a different time.

Hello MtnBkr, get the phone number of the local circuit court judge and give them a call or e-mail them. Explain what you want it for and ask what his/her requirement is. They will most likely ask you for something in writing. If you have a CCW, I would mention that as well...
