Question About Mini Shot Shells

Well I finally got around to trying out those Aguilla mini shot shells in the Benelli Nova. They functioned just fine and made the cutest little "POP" sound when they fired. No kick, no flash just a little shot gun blast in the target.

I really just tried them as a novelty and will probably never use them again but a legal question came to mind.

You can stuff 7 of those in the Benelli Nova. I would assume you could stuff 8-10 in a Benelli M1 Semi Auto. Well based on the AWB you cannot have a pistol grip and fixed magazine capable of holding more than 5 rounds of ammo. Those little suckers would put capacity up to 8-10 rounds.

Conversely what about a guns chambered for 3 inch magnum shells. A magazine tube that only takes 5 shells of 3 inch might take 6 of 2.75 inch.

So how the heck does the law apply. It is written vaguely enough.

Just a curiosity really. Anyboy have any idea since you could argue that x gun only holds 5 rounds of 3 or 3.5 inch or conversely they could argue that x gun holds 10 of those little mini shells.

There are no legal issues with a pump gun and there is also no problem with a semi-auto as long as it has a sporting type stock.

You can stuff as many of those mini-shells in your Benelli as you want. They won't function the action.:rolleyes:

People can put 13 rounds of 9mm in a pistol mag meant for 10 rounds of .40 S&W. This is totally legal in the eyes of the BATFE so long as the magazine will still feed .40 S&W properly. I would assume that putting 10+ rounds of mini shells into a shotgun would be looked at similarly.

I can put 14 in my Winchester Defender; and they hand-cycle just fine - I haven't been to the range yet to shoot them.

If your shotgun has a 3" chamber, then the capacity should be determined with 3" shells; so what if you can stuff more of a shorter round in there?

SDC hits on the other point. How is mag capacity determined. Is the tubes capacity determined with the maximum shell the receiver is designed to take?
