Open carry in CA--a bit long

Not sure where this thread belongs as it is one part personal observation and one part legal questions.

While my wife and I sipped our 'lahtays' at the Danville, CA Peets Coffee shop during a break in this morning's bicycle ride a gentleman in tactical style was talking to one of the regular customers. The gentleman was wearing black combat boots with bloused black tactical pants, a brown woven gun belt, black T-shirt and a holstered auto.

I give the full description so that if this gentleman is on this forum he can join in with an "inside viewpoint".

What was interesting to me is my reaction to the open carry--not the same as my reaction to several threads on THR and TFL where individuals have tried open carry where it is legal but not common and posted reactions.

In most cases I understand getting sheeple used to the idea that firearms can be around but not a threat. Of course threat is the first reaction the sheeple have, so I wonder what is accomplished. I tend to think that there is a greater chance of confrontation and negative publicity or in bad neighborhoods to be seen as a challenge. Again this is in areas where firearms are rarely seen in public. Not like the restaurants that Tamara frequents.

This morning I scanned the usual array of customers for reactions. I didn't see anyone obviously disturbed and no one was confrontational. I didn't see the logo on the gentleman's shirt and that may have provided an answer to the general reaction. I do believe he may have been on the way to a training session. However, unless the carrier was an LEO, I would find no more need for open carry than going to the range for target practice or competition. In terms of self defense, Danville is about as prissy and Yuppified place as you can find.

In this case my reaction was pretty much the same as when I see people who are obviously looking for attention (the cigarette gesture in the past, a flip of the blonde hair, bringing along Fido to get an intro, general overattention to trendiness, silicone boosoms): a degree of aversion to the attention seeking and contrariness driven lack of attentiveness.

Of course if open carry were more common, then the situation would turn to shop talk as it does with new mothers, dog walkers and bicyclists.

On the legal side, what is the law on open carry for non-LEO? For concealed carry without a permit (trunk of car on way to the range, shop or residence) it is illegal to tarry at the coffee shop on the way to the final destination.

I believe open carry is perfectly legal only if the firearm is unloaded.

I suggest reading "How to Own a Gun and Stay out of Jail," by John Machtinger. It goes over most, if not all, the pertinent California gun laws.

As an aside, when I went to the Norco 3-gun match there was a gentleman at the Farmer Boy's restaurant who was carring openly. He was wearing shorts and an instructors t-shirt, but I do not know if he was LEO. No one seemed to care.

My understanding is unloaded and no ammo on the person. You wife could carry the mag or speedloader for ya.

There were two brothers who now live in Arizona who would open carry in California in the mid 1990s. One carried a semi-auto, the other a revolver. One would carry the other's blammo. Cops would stop them (which is what they wanted) but had to let them go.

The gentleman this morning had a magazine in the pistol, but I don't know whether it was loaded. Being an RO and sometimes semi-competitor a hot gun is the first thing I check for.

Hmmm. Danville, eh?

There is a guy who lives in Danville, he's a member of the "Contra Costa Sheriff's Posse", he has a CCW permit and he's known to use his Posse gold star as a "flash tool" to fake being law enforcement. I staked out one parking lot for two weeks with a camera, after getting word it was seen there. It was a black Dodge Durango, large-rim custom wheels, blue and white "dashboard lights" and the words "police interceptor" all over the back.

Danville PD had been ignoring all this despite massive illegality - they're actually deputies, and they knew this guy was in tight with the sheriff.

However, somebody else had checked with a local Dodge dealer about two weeks before I prodded around...the guy's story was that this was a factory police setup, and that was a lie. So I think the guy's story around town on the truck fell apart, and he took it off the street. "The great Durango hunt" therefore came to nothing.

Anyways. This sounds like the same dude. The description I have is he's maybe a bit under 6", good condition...and black.

It is my understanding a fisherman can open carry a holstered loaded handgun in California. One would have to be very careful and aware of city limits or other areas where local law would not permit open carry in city limits, etc...

Jim,

This gentleman appeared to be weathered caucasion, rather than light black. He had short hair, might be in mid to late 40's with an LEO/tactical physical build. It was about 7:30 or so on Sunday morning. I did not recognize him as a regular, but he might be.

One problem I would have describing him accurately is my aversion to giving attention to attention seekers. He may have been LEO so I could not assume an illegal carry. If I knew for sure that he was carrying illegally, I'd have every mole and hair on my list. At this time I was paying more attention to the other customers, trying to get a feel for their RKBA attitude.

Probably an off-duty Sgt. or Detective (or above). They're not *supposed* to open-carry off duty but this isn't the first time I've heard of them enjoying flaunting their "elevated status".

I often see them in plainclothes with a gun in plain view,not neccessarily open carry though. i.e he might have left his vest/shirt in the car.
though he could have been a fed of some kind,the U.S park police have
a similar uniform ...it wasn't a sig 9mm was it?


I open carry to gun shows all the time,patrons raise eyes & cops don't bat one!
I check it in at door and they know it's unloaded...no big deal,even in Frisco!

It is just plain pointless to ask Guy B. Meredith (me) about any sort of auto other than a Ruger MKII. I can't understand them automatical thingees and stick to revolvers. :confused:
