The law was supposed to go into effect on 7-1. Last I heard, Joe Baca's (second) lawsuit had petered out. Unfortunately, I also heard budget problems were threatening its implementation. What's the story?

The law went into effect on 7/1. It provides that the Department of Public Safety has to start issuing licenses on 1/1/4. The DPS put the applications for the permits up on its website on 6/30. This same application allows instructors to get certified to give the class that are necessary to get the license. The DPS has not promulgated the regulations for what exactly must be done in the class/how the licenses are issued: they are writing them and have not yet had the required administrative notice and comment meeting for the public. It's New Mexico, so it might not be done in the most timely fashion, but it will get done.

There has been no lawsuit, and there is not really any talk of a lawsuit in the media. The governor - a Dem who's willing to whack on other Dems who get out of line and who is pretty into central power - made it clear that the CCW legislation was one of (I think) 18 pieces of legislation he wanted passed this year. It got done. I don't think he'd take kindly to anyone screwing with his legislation. The idiots who filed the last writ are politicians and Dems, and I think they might be wise enough to realize that if they mess with Big Bill on this, they'll get their willies whacked. Big Bill has higher offices in mind, and he wants his NRA A+ rating unsullied by the agendas of those ding-dongs.

Finally, there are 2 (of 5) new justices on our supreme court. It's a whole different playing field over there. The court might not even accept a writ (it was really an unusual procedure for them in the first place) this time. The present legislation does not have the stupid and unconstitutional (NM Const) local opt-out provision, so anyone bringing a writ would have to find a legitimate basis on which to challenge the new law.

So . . . slow but steady.
