I have a question and cannot find the answer anywhere, so I am throwing this out to you guys.
To purchase a handgun in North Carolina, you have to get a handgun purchasing permit from the local sheriff ($5). No big deal there, but what if you have a C&R license? Do you still need to get a handgun purchasing permit? Where does it say that?
My brother is a resident of North Carolina, and has a C&R license and he believes that he does have to get a permit. I’m unsure, so I called a local gun shop. The owner said that do NOT need to get a permit if you have a C&R license. The North Carolina Firearms Laws book does not specifically say that a C&R releases you from the permit requirement. Actually, it doesn’t address C&R at all.
I called the State Attorney General’s office and asked them. The nice lawyer I spoke to said that if you are buying a gun to go in your inventory, then you do Not need one. If you are buying one for your own use, then yes, you DO need one. I get the feeling that he did not know the difference between a type I and type III. I told him that a C&R is just a collector’s license, so there is no inventory, only for personal use/collection. He reiterated that for personal use, you DO need to get a purchasing permit and send it to the seller.
So in essence, if my brother wants to buy a CZ-52 from Aim Surplus, he needs to send Aim a North Carolina Handgun Purchasing Permit.
Can anyone provide specifics?
