Dear Mr. XXXXXXX:
Thank you for contacting me regarding the expiration of the Assault Weapons Ban and your opposition to its renewal. I appreciate hearing from you and welcome the opportunity to respond.
As you know, the ban was signed into law in 1994 by President Clinton and is due to expire in 2004. Representative John Conyers (D-MI) and Carolyn McCarthy (D-NY) have introduced H.R. 2038 which would extend the ban on assault weapons. Senator Schumer has introduced companion legislation in the Senate to do the same. At this time it is unclear what the future hold for these bills.
The ban effectively eliminated the market for dangerous weapons such as the TEC-9 and clones of military assault weapons. The President has indicated that he supports an extension of the ban. The Congress has not scheduled action.
You may be interested to know that with my support, H.R. 1036, The Protection of Lawful Commerce in Arms Act passed the House by a vote of 285-140. It now awaits action in the Senate. The bill would ban frivolous third party lawsuits against gun manufacturers and dealers. Gun makers are no more liable for the unfortunate death of an individual during an armed robbery than a pharmaceutical company is for a willful misuse of a prescription drug. In reality the trial bar is seeking another deep pocketed defendant to sue along the lines of their successful with tobacco companies and lead paint manufacturers.
