Florida & Auto Knives ???

I have a good friend ( a retired LEO) who is planning on moving to Florida.

He plans on getting his CCW permit right away (by the way, do you need a Florida CCW permit to carry an auto knife concealed?).

What are the laws and regulations regarding buying and carrying auto knives in Florida?

Is it true you have to be military or a LEO to buy an auto knife even in Florida?

There is only one type of knife that is prohibited in Florida, the "Self-Propelled" knife.
790.225 Self-propelled knives; unlawful to manufacture, sell, or possess; forfeiture; penalty.--

(1) It is unlawful for any person to manufacture, display, sell, own, possess, or use a self-propelled knife which is a device that propels a knifelike blade as a projectile by means of a coil spring, elastic material, or compressed gas. A self-propelled knife is declared to be a dangerous or deadly weapon and a contraband item. It shall be subject to seizure and shall be disposed of as provided in s. 790.08(1) and (6).

The concealed carry of any knife other than a "common pocket knife" requires a state CCW license.

Florida allows possession and carry of auto openers. They are treated as pocket knives.

You have to have your CCW to carry "any" weapon concealed (other than a common pocket knife as mentioned above). Gun, knife etc....

The federal law for switchblades in an interstate transport law. Only military or LEO, or one-armed people (seriousely) can "legally" purchase auto-knives across state lines. But it's done all the time.

Luckily, one of the best auto makers around, Microtech, is right here in Florida and there are also many auto-knives available at the area gun shows.

The laws on doing business in switchblades is so contradictory as to be puzzeling.
The federal restrictions are on interstate commerce and using the mail to send across state lines. The interstate commerce rule only applies to the seller and only government purchasing agents of the military are exempt. The mail rule applies only to the sender and not the recipient and the exemption applies to LEO and Military. Both exempt "one-armed men". If he buys an Italian switch in FL he is not breaking any laws at any level. The guys that brought them into the country violated customs statutes and if they crossed the border from another state the folks that shipped them violated the interstate commerce law. If they used the USPS then they broke that one as well.

Crazy set of laws.
