I would like to start a letter writing campaign to have FOPA amended to allow transportation of magazines and other accessories which may be prohibited by state through which you would travel. I'm proposing something allow the following lines.
18 U.S.C § 926A. Interstate transportation of firearms was enacted with the intent of providing persons who can legally posses a firearm in one location to transport to another location where they are legally allows to posses that firearm.
Several states have passed laws restricting possession of accessories related to firearms within that state. For example, in the State of New York, a magazine with a capacity of more than 10 rounds manufactured after September 14, 1994 is illegal to posses.
In Virginia, I can legally possess magazines with a capacity of more than 10 rounds. In Vermont, I can legally possess a magazine with a capacity of more than 10 rounds. However, if I were to drive from Virginia to Vermont, I would not be able to transport the magazines but I would be able to transport my pistol.
Please introduce legislation to amend 18 U.S.C § 926A to allow transportation of firearm accessories.
Possible new language for 18 U.S.C § 926A might read:
Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console. Furthermore, any person shall be entitled to transport a firearm accessory, such as but not limited to ammunition magazines, for any lawful purpose from any place where he may lawfully possess the firearm accessory to any other place where he may lawfully possess the firearm accessory.
