Magazine alteration legal?

Would it be legal to take a "high capacity" pre ban magazine and modify it to accept even more cartridges?

Specifically, what I have in mind is the .45 conversion for Uzis. For some unknown reason, the magazines are 16 rounders. I'm interested in converting some to 25 or 32 rounds if possible and legal.

The latest issue of Shotgun News, Feb. 3, 2003, page 30, has a response from BATF dealing with modifying a .45ACP M3 magazine. Essentially the BATF said it was ok to modify the magazine so that it could be used in another gun. However altering it to use 9mm cartridges was considered to be manufacturing a high capacity ammunition feeding device which is prohibited.

ATF has ruled that you may modify any pre-ban magazine as long as the magazine still functions in the gun it was designed for, otherwise, you have made a new magazine. The main theme is for magazines that are altered to function in a different firearm than the one it was designed for.

Since you are taking a .45 pre-ban Uzi magazine and modifying it, and when you are done, it will still function in a .45 Uzi, it is a legal modification.
