Question for SBS/AOW owners

I have a feeling this is going to be a cold November and an even colder January and beyond depending on how many seats the Republicans lose. I am looking to insulate myself from it in purchasing all the firearms I have had my eye on, as they may be illegal to manufacter in the near future/forever.

This is a question about Short Barrel Shotguns (SBS) and Any Other Weapons (AOW) as defined by the BATFE. I am looking for a firearm that requires the $5 AOW stamp rather than the $200 SBS stamp.

If you are an SBS/AOW owner, how long did it take to get approval from the BATFE to modify or take possesion of your firearm? Did you go the individual ownership route or did you designate it as the property of a corporation or a trust?

I am looking into purchasing an AOW shotgun, specifically the Serbu Super Shorty (SSS) (http://www.serbu.com/top/superShorty.php). Do you have experience with this gun? If so, was that experience with the Mossberg 500 or the Remington 870 model? I like the Remington 870s, I have no experience with Mossberg 500s, but what about the 870 as compared to the 500 justifies a $50 premium? Do you have experience with another AOW and would recommend it over the SSS?

My most recent Form 1 took about two months, which is about normal right now:

Individual. I would go with a trust if I couldn't get a signoff.

I sent in a form 4 for a Serbu Super Shorty on May 15. Filed as an individual. The check was cashed at some point in the last month or so (it was on my last bank statement). Nothing yet.

I can't help you on the shotgun question, but I sent in a form 1 in March for a SBR and it took about 9 weeks.

About two to three months, three different form 1s. :)

Trust route.

If you're doing a form 1, just make it an SBS - AOW is still $200 to make, but you wouldn't be able to put a stock on it in the future.

Approved transfer is in today. Filed as an individual, 48 days mailbox to mailbox!

Also, there is an advantage to manufacturing an AOW. SBSes require prior approval from the ATF to transport across state lines, while AOWs do not. You can go wherever you like, whenever you like, with an AOW, as long as it's legal in your destination state. And AOWs are legal in more states than SBSes.

My form 4 was cashed on May 19th...went pending on June 19th...today the paperwork arrived at my C3 dealer.

Those Serbu's are pretty nice, but I'd rather have the option of 5,8, 10 or 20rd mags.

I have all my SBR - Living Trust/Form 1 paperwork prepared and ready to mail tomorrow(I must have gone over it ten times by now:barf:), but I keep reading different opinions on different gun boards on who to make that $200 money order out too.

Some say 'BATFE', or 'Department of Justice', or even 'Treasury Department'. I really don't want to make a mistake on this point so I need some help.

What is the general consensus here, and for those who have gotten their NFA stamp... who did YOU make the check out too?

BTW, VERY nice shotty!!!!!!

I have had good results with "BATFE". The Department of Justice is their parent organization.

I actually think I might have answered my own question.

On the current Form 1 I'm using(OMB no. 1140-0011 09/30/2010), in the "type of application" box it says to make the money order payable to the Department of Justice.

Even though my question is answered I will leave this thread up for other folks looking for the same type of info.

All of my F1s and F4s were approved with DoJ/BATFE on the check.

I used a personal check, made out to "Bureau of Alcohol, Tobacco, Firearms and Explosives."

I got my SBR tax stamp back from the Feds! 57 days from my hand to approval. Now I just have to get the AK chopped, and I am good to go.:D

I sent my last form in (check made out to Department of Justice) on June 30th. They cashed my check on July 15th, stamped my form on August 28th and it was in my mailbox on September 2nd. 64 days door-to-door.

I've done a few NFA stamps now, all under my trust. I'm not sure if that speeds things up or not, but my very first one took 14 weeks. :eek:

I have a couple SBRs, an SBS and a can now, but I have two more cans and an AoW on the list of things to get before the end of the year.
