Can a CA resident get a C&R license?

I am trying to buy an SKS from an out of state dealer and none of the dealers in my area will help me. So I figured I would circumvent them by trying to get a C&R license, but I am unsure if it is legal to get one in California. Does anyone have any information that would help me out?

assuming that you can get your local CLEO to sign off on it, I don't see why you couldn't get a c&r FEDERAL firearms licence.

Yup. You just can't buy C&Rs that are younger than 50 years. You also can't mail order handguns without going through an 01FFL, though you can buy them out of state in person and bring them in (filling out a registration form immediately after bringing them into CA). And of course certain fun guns, like SKSs with grenade launchers are verbotten. We can get the Albanian SKSs (no launcher attachment) though.
Make sure to use a sheriff as your CLEO if you can, as from what I've researched they usually just file (or round file) the application copies versus city police chiefs that may actually try to butt in and deny you. Best way to send the courtesy copy to the CLEO is to use the formula letter on cruffler.com.

I believe you can order C&R handguns, but they need to be on the list and you have to have your CA certificate of eligibility. I hate the politics of this state.

C&R doesnt require CLEO signature, just CLEO notification (ie: complete the form in duplicate, mail him one copy when you mail the ATF their copy, the forms come in pairs and are marked 'ATF' and 'CLEO').
And yes, you can get one, but you're limited to 50 year old long guns with all the cool features chopped off.

You can order C&R handguns but they must be sent to a dealer for transfer. You cannot have them sent directly to you. All the COE does is exempt you from the waiting period at the dealer. It is not required otherwise.

That doesn't make sense EOD guy. Yes I know that many laws here do not, but it still doesn't even make PRK sense. Absolutely nothing prevents you from having to wait the 10 days on any modern purchases. Not your CCW, not your C&R, not your COE, nothing except being a cop and having official letter head. However, your C&R license lets you get C&R guns all you want, whenever you want, from whoever you want. Why would you need to have a handgun sent from another dealer, to a FFL near you, just so they can hand it over to you, a C&R license holder. If the firearm is not C&R technically, I don't see how they are just going to be able to hand it over to you.
This is a good one to research. I will look it up later today when I have time. Try to find some supporting documentation too. Thanks.

The Empire Arms website has a nice page giving a synopsis of CA C&R laws. On the C&R pistols, I'm positive that even though you can by as many as you want in person, out of state, without a wait, you cannot have them mailed directly to your home in CA. I'm at work so don't have the BATF book in front of me, but if it's not posted by the time I get home, I'll cite the section on CA law.
Believe me, I've looked into this. I would like nothing better than to sign up for the "C&R 1911 of the month club" and have pistols delivered to my door.:D or is that :fire: ?

Yes you can get one in CA but it may not be worth it. All handguns must be shipped to a 01 dealer as said and waiting period does apply as well as dros-not sure about COE and any safety B.S. they do now. Does not have to be on the "List" as long as it's C&R. Oops must be on C&R list.
I Got a C&R about 2+ years ago to purhase a Systema 1911. After all is said and done re: firearms laws in the state probably wouldn't have and most likely will not renew.
CLEO notification is just that-you sign the form and mail it. Does NOT require the CLEO to sign, approve, etc...

According to this I was wrong. I don't remember all of the points exactly, so read through it for yourself. It is all there. I can't verify all of this information. As with most PRK laws, the best thing to do is call the BATF and the PRK DOJ for definite or indefinite answers. Afterall, lots of this is up for interpretation and they are probably just waiting for a test case to figure it all out. Good thing I don't have any money so I probably can't afford to buy a gun to be the test case!

C&R in Cali is easy to get. The only problem is that it doesn't affect your ability to buy handguns. All handguns must go through 01 FFL dealer, no exceptions. Also, make sure that the SKS you're looking to get is approved by fuhrer Davis. Yugo's are out because of the evil grenade launcher. The one's that I've seen with compensator instead of the launcher are no longer C&R due to the permanent mods. Any SKS that excepts detachable mags. is also out, because of the "assault weapons" ban.

Thanks for the information guys, I think I am definitely going to apply for a C&R license. If anything it will make buying old rifles easier. After the fiasco of trying to find a dealer to do the paperwork for an internet sale I have a great desire to remove the middleman from any transactions.

You won't regret it. Despite some of the stupid CA regs, there's nothing like having a half dozen rifles delivered straight to your door with no CA paperwork and being able to thumb your nose at the CA AG. :D
Don't forget to send copies of your license to Brownell's and Midway. Your dealer discounts will pay for your license many times over.

The reference in the Penal Code for the waiting period exemption is PC12078(t)(1).
I've been working with both Federal and State regulations for most of my adult life. I learned a long time ago that logic and common sense do not apply.
