Felons and blackpowder rifles

i have a younger half brother who is getting out of prison in a couple of months. since nobody in the family really has much to do w/ him anymore i was thinking about driving out there, AL, and picking him up. i wanted to take him hunting and was wondering if he can use my muzzleloader.
i know that the ATF does not consider them firearms and that they can be sold mail order does that mean that he can be in possesion of one?

Not to be flippant, but you need to check your state/federal laws and not an Internet forum.
Before he was convicted, your half-brother must've had a lawyer. Ask him for a written opinion.

blackpowder=non-firearm
felon +blackpowder=X

You must not run afoul of the law as much as your half-brother.
Lawyers give opinions because, truth be told, the laws in this country are so :cuss:ed up, so complicated, and can be so easily stood on their heads, that NO ONE could ever honestly figure even one of them out!
felon=no firearm per ATF JBTs = Federal
blackpowder=non-firearm
felon +blackpowder=X - WA St. for example where possession of a blackpowder rifle by a former felon is A FELONY = State

ATF rules exempt blackpowder as firearms. However, like Hank says, check your state laws. In CA, blackpowder guns are considered as firearms and must be signed for. :rolleyes: So, if you and your brother are in CA, no gun, blackpowder or otherwise. Best he can do in CA is a Farco air shotgun.

Also check with your brother's parole officer. They are the ones who write the stipulations to a prisoner's early release, and they are the ones who can recommend their recommittment. If the PO says "NO", then the answer is "NO".
This includes hunting w/ a bow, a knife, or even a sharp rock....

Seeker is right. POs are like little tin Gods that have the power yto violate him for spitting on the sidewalk or even not showing up for an appointment at the Parole Office just to say "hello". His PO holds the keys to the cellblock and can voiiolate him regardless of the law.
You can hope his PO is cool. Chances are he isn't because he has been screwed over so many times by those who came before.

I do not think that it would be a wise idea to contact his parole officer about a question like this. POs are not your friend, any reason to make one suspicious is inviting trouble.
I'd follow HankB's advice and consult with attorney.

my Friend got his in the mail from Cabellas.
but you can not own one as a felon or conceal/carry loaded
