So, just because my computer CAN support pop-ups, it's OK for data miners to start putting them in there?
(BTW, I don't & won't download stuff like Gator & WhenU. My data miner problem comes involuntarily...:fire: )

Note that in this instance the people who received the ads essentially agreed to them by downloading specific software that enables these functions.
So, in this case, yes.
In essence you've done the equivilent of hanging out a sign on your front door that says "Soliciters welcome here."
I'm not at all surprised by this ruling.

Great....when I hit the link to the ruling, in the first post, I got a pop up for a gambling outfit.
Darn sho didn't intentionally consent to receiving the pop up. And had no choice in the matter if I wanted to read the article.

Use mozilla. It blocks popups with no external programs necessary. Opera might do this too, but I don't recall.
I really have very little sympathy for people who don't utilize programs that are trivial to install and that would solve their problems. There is no necessity to use IE.
How can you justify having courts enforce property rights WRT popups when you won't take a few minutes to get a program that'll fix the problem for you? Mozilla/Firebird even lets you block ad images from specific sites.

I think I put in www.hecklerkochusa.de instead of www.heckler-koch.de or vice versa and ended up with either a porn site or something and something popped up and I had to CTRL-ALT-DEL to close it...like I trust them with their damn little 'cancel' buttons that say I consent to have them send me pr0n e-mails and tell me that I'm overweight, in debt and have a small wee wee!!! :cuss:
Like I take the wrong turn in the neighborhood and get gang raped because I consented to it :cuss:

Just use free software available below to block pop-ups, dataminers, spam, etc.

Please note that this case was NOT brought by end users (i.e., you and me).
This was brought by website owners.

I upgraded from the wretched Microsoft browser to Mozilla several months ago. It's by no means a good program, but it's definitely less awful. I've turned off all pop-up windows and limited animated GIFs to one cycle.

Opera. I still use IE, but when I want to go pop-up free, its Opera for me.
