Question over at bladeforums -
"My uncle wants to pass down a gun to me but we need to transfer the ownership title from him to me. How do we go about doing that? what are the steps, cost, and other details? also where is it done? "
What's the law on this one caly experts?

Good question. Moving this to Legal & Political, as there are more likely to be answers there.

Hso:
Parent - Child can go without FFL. Everything else requires an FFL and a ten day wait.... unless it is a C&R rifle that is over 50 years old and you have your C&R. C&R pistols must go through FFL, unless you are physically bringing it into the state... ie... driving it over the border.
The gun must be currently legal to purchase. If it isn't, I believe that it must be sold out of state, or destroyed. You can not pass on an evil gun.

If it is a C&R rifle or shotgun over 50 years old, no FFL involvement is needed. Anything else must be processed through a dealer as a private party transfer and there is a 10 day wait before you can take possession. Handguns do not have to be on the approved list as private party transfers are exempt. The only other restrictions is that so called "assault weapons" cannot be transferred.

PC 12072(d) speaks to transfer of firearms where neither party to the transaction holds a dealer’s license.
PC 12078(c)(2) speaks to transfer of handguns between individuals of the same family (parent-child, or grandparent-child)
PC 12078(c)(2)(A) speaks to requirements to report the transaction to CA DOJ within 30 days
PC 12078(c)(2)(B) speaks to the requirement that the recipient must obtain a Basic Firearm Safety Certificate
PC 12800 speaks to the establishment and requirements of the Basic Firearm Safety Certificate
I just recently had to ferret this info out. There's another subsection that speaks of all the substitutes for having a Basic Firearm Safety Certificate, including among other things, having a hunting license, or an Honorable Discharge (DD214), or being a (retired) LEO.
The opening question mentions an Uncle - sounds like they'll have to go through an FFL, pay the fees, wait the wait, endure the full range of legal requirements.
