ON-LINE POLL: SHOULD THE CALIFORNIA RECALL BE
DELAYED?
On Monday, a three-judge panel of the 9th Circuit
Court of Appeals ruled that California's recall election
should be postponed until March 2004 - the next
regularly-scheduled statewide election.
Citing "equal protection and fundamental fairness"
concerns, the panel concurred with the ACLU's argument
that the election should not be held until outdated
punch-card voting machines are replaced in the six
counties that still have them. Because the court "stayed"
its ruling to allow for appeals, the order will not go
into effect for seven days.
