It is people like this that screw things up for all of us

Local guy...enjoying adult beverages

Hears a noise

Gets his handgun...decides to look around in his dark house

Trips and fires a shot that goes through the wall of his neighbors house

Decides to have a couple more beers and go to bed.

Neighbor has no sense of humor calls the cops.

Supposedly he has 40+ guns...said he was thinking of selling them becasue he is recently unemployed.

I think that employment just became his # 2 problem

Sounds as if he wasn't following the 4 rules. Let's not be too smug, people on this board have admitted to ND's too ... it can happen to anyone who isn't careful. Of course alcohol and guns don't mix just like alcohol and cars (though back in the old days it was treated with much less derision - go figure).

I don't drink and don't plan to start. That beer money could be spent on guns!

I mean really....

Remember Bob...he was so hammered the Swat Team had to go in and wake him up!

This dufus is just lucky he didn't wake up with a gun in his hand or he likely would have gotten blown away.

So, if the police yell "come out with your hands up", and you are physically unable to do so due to unconciousness, be it from alcohol poisoning or injury, you are guilty of a crime? Huh.

Failure or refusal to leave premises or property upon request of a peace officer - penaties - payment of costs
(1) The general assembly hereby finds and declares that any individual who violates any provision of this section presents a significant threat to life and property in this state; that such violations require the use of highly trained personnel and sophisticated equipment; and that any such individual, if guilty, shall be convicted of committing a crime and be required to pay for any extraordinary expenses which are the result of said violation.
(2) Any person who barricades or refuses police entry to any premises or property through use of or threatened use of force and who knowingly refuses or fails to any premises or property upon being requested to do so by a peace officer who has probable cause to believe a crime is occurring and that such person constitutes a danger to himself or others commits a class 3 misdemeanor.

Some years back the legislature passed it in an attempt to deter barricade situations and make persons who cause them finacially responsible for the costs in overtime and equipment

If they are charging 18-9-119, then the police are alleging that he knowingly refused to leave ( the ole "I'm drunk so I'll just pretend this isn't happening, I don't hear or see you ploy"). :rolleyes:

I see what you're saying Roadkill. I guess the court will discover whether it's a valid charge or not. The payment part is probably what the police are banking on. I guess he has some nice guns. :)

FTR, I have no sympathy for this loser either.
