Yesterday, House Bill 1180 was approved by the Senate Judiciary Committee. The bill now heads to the Senate floor where it could be considered any day.

Sponsored by State Representative Steve King (R-54), HB1180 would exempt Colorado concealed handgun permit holders from the background check requirement for the transfer of a firearm.

Please contact your State Senator TODAY and respectfully urge them to support HB1180, without any amendments, when it comes before them for a vote.

Everyone needs to contact your Senator and show support for this bill.

I just found that link. It looks like you can narrow it down from there depending on who you're looking for.

One of the state reps that I e-mailed said that 1180 was being amended to some significant degree. I'll pull up the e-mail.

This is a Colorado State House Bill and as such we all need to contact our Colorado State Senators and Representatives and ask for there support.

Select Senators and Representatives by district to locate yours, although I guess there would be nothing wrong with sending the letter to everyone of them! ;) Tell everyone that you know to call and email, I for one, would really like to see this pass.

RMGO sent me something saying that the bill has been "gutted", and amended to only require CCW applicants prove their citizenship which is required by the ATF for background check exemption. They also said they were working with the sponsor to fix it.

"[HB 1180] passed the committee, but only after it's main goal was gutted. The legislation, HB1180, now simply conforms Colorado CCW law to federal standards by making applicants attest to U.S. citizenship (which is required by the BATFE for Brady Bypass). The bill now goes to the full House for debate, and we're working with the sponsor to see if it can be salvaged."

I got a response consistent with what Westermeyer says above.

Thanks for your input; this bill was passed as substantially amended. Because of concerns about whether Colorado's background check meets the requirements of the ATF, the provision of the bill allowing those who have a concealed weapons permit to bypass a background check when buying or selling a gun was removed by the sponsor. The only provision remaining adds some identification requirements that are designed to make sure our background check requirements satisfy the ATF requirements. Rep. McCann.

So CCW exemption couldn't be legally actualized because Colorado's CCW process doesn't make make applicants attest to US citizenship? Or is it Colorado citizenship?

I don't really remember the questions on my CWP application, but I'm suprised there was supposedly nothing asking me if I was a U.S. (or Colorado, and by default, U.S.) citizen. :confused:

HB 1180 died in committee, but has gained new life. It was restored and passed in the House, and is now in the Seante. Here is a link for the latest from the Colorado State Shooting Association.

Congratulations. Thanks to activists like you and our law enforcement allies, we blocked an effort by gun lobby extremists to weaken Colorado's law requiring background checks at gun shows - which was overwhelmingly passed by voters just a couple years ago.

Apparently the anti's of our state know somethign we don't or are merely blowing smoke about this one... :confused:

I made my call to the Gov and representatives already and looking forward to taking a step in the right direction...

EDIT... HAH I also just noticed on that site they reference the Gov Bill Owens... seems like their stuff is a tad out of date...

does anyone have a link to a copy of HB1180 that is sitting on the Governors desk? I can't say I am comfortable calling and asking him to sign a bill that I have only heard about on the internet. I'll research it as much as I can, then call if it is something that should be signed. I am all for passing law that would let me with my CCW skip the background check, but some bills have some weird wording and I don't take politicians word for it that it is all good.

It conforms Colorado's CCW to the ATF's requirements for NICS bypass per 27 CFR § 478.102 (basically requiring attestation of U.S. citizenship).

The bill was gutted in the House, but Sen. Brophy revived it. The version on the Governor's desk is the one we wanted to land there.

Previously issued permits do not qualify for ATF's NICS exemption, hence HB 1180.

It costs $50 to renew your permit. That's two out-of-state transfers at my friendly neighborhood gun shop. I imagine I'll be doing at least two such transfers in the next five years (don't tell my wife ;)).

Plus, with BHO in office the instant check may never by "instant" again. I had to wait overnight the last two times I bought guns since Nov. 2008.

just got home late from work, so I'll read it tomorrow. But, if it wants to change it to "Are you a U.S. citizen, yes or no" and no will be a disqualify answer for a CCW that is not the bill I want on his desk. I'm not going to jump to conclusions right now, I am tired and will post more tomorrow after I have read it.

ok I wasn't going to be able to sleep. I read it. Page three answered my question and I as a permanent resident will still be allowed to get a CCW. The rest is well written as well, so I will be calling first thing in the morning to show my support for this bill.

Allegedly, his reason for vetoing was that the bill included no provision to verify that a permit had not been revoked. It seems like a simple call to the issuing Sheriff's Department could solve that, although I don't know if it would have been necessary to explain that in the bill.
