TWO observations here: 1) the attackers were known by the victims and 2) the attackers WERE armed with their FISTS!
oh and uhuuuuuuuuuhhhhhhhhh, the homeowner had a self defense weapon

MANSFIELD (OH) -- No charges are expected to be filed in the fatal
shooting
of Keith D. Woodhull, 24, of Mansfield. He was shot and killed about 10
p.m.
Sept. 13 in Tucson, Ariz.

He was shot several times after he and an Arizona man severely beat
Wesley
Stevens, 58, inside his house, according to the Tucson Police
Department.

Both men were shot and killed by Stevens, according to police.

One man was found in front of the home and was pronounced dead. The
other
was found in a car two blocks west of the house, police reported. He was
pronounced dead at the hospital.

The preliminary investigation by homicide detectives found that Stevens
was
home with a female acquaintance when two of her friends entered the home
and
assaulted him.

Stevens shot both men during the assault, police reported

If he was armed, you'd think he'd have shot 'em before they beat the crap out of him. Maybe he had the gun stashed somewhere and had to fight his way to it:confused: ? A good example of why you should carry in your house.

If you do, you will go straight to jail in most states. The "tresspasser" has to demonstrate a threat to the homeowner's life to justify deadly force, and a clenched fist won't do it. The only reason this guy will probably never be charged is because he took the beating first.

Out here in Oakland, we had a homeowner charged with ADW after he chased a child molester out of his kid's room in the middle of the night with a baseball bat and cracked hsi skull open two teps into his back yard. The DA said the perp was no loonger a threat once he got out of the house. John Walsh featured the story on Most Wanted and the Oakland DA's phone lines melted... after that the charges were dropped.

Another 80 year old man shot dead a burglar breaking into his locked bedroom at night with a crowbar and was charged with murder. Local news ran the story and the new set of phone lines got melted. man was released.

Out here in kali, if you use deadly force you can be sure you will go to jail. Period. The charges may later be dropped, but the DA's want to make sure you get the feel of the bright orange issue at the county jail as punsihment for defending your life. The message out here is clear: if you think you have the righ to defend yourself, move to another state.

California, as you seem to indicate, is not "most states."

In Minnesota, there is a "duty to retreat" EXCEPT for in the home.
In Minnesota, you can only use deadly force to prevent death or GBH, EXCEPT in the home, where it may be used to prevent a felony.

In any case, two unarmed men who have broken into your house and are threatening you DO constitute what a reasonable person would find to be an imminient risk of death or GBH.

And pointing a gun at an intruder in your home is not the same as shooting them.

So...

IF it were me, in Minnesota, and
IF I had the gun on me...

I would have drawn and ordered them out of the house. If they came toward me, they would have gotten shot. And I'd be on fairly safe legal ground.

we have the best of both self defense laws in Tn. There is no duty to retreat before a person threatens or uses force. and who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence. are all covered under the 39-11-611. Self-defense. laws.

so if you enter my home uninvited, unlawfully, or forcibly I can by the laws in TN, drop the BG and not have retreat.

What the prosecutor does and what the law states are sometimes two different things. It's been a while since I looked at it, but last time I checked California was pretty good on this - basically if he's in your home after dark and univited he's presumed to be there to kill you and it's open season.

It was not that way 'bout 20 years ago, but then this guy called Richard Ramirez, a.k.a. The Nightstalker, began paying late night visits. It was okay as long as he was killing poor women in Los Angeles, but then he had to go hit a few in Conservative and rich Orange County. Gun stores got emptied and the law got changed.

I haven't heard of it being changed back. Has it been?
