kendradad May 3, 2009, 04:23 PM Can I get a FFL license for show use on the weekend show tour? I live in a neighborhood that will certainly have bylaws regarding any home businesses. I do however have a safe at home that I can safely store guns.
Does anyone have experience with a home based FFL, even though I will not use my home for sales.
In lieu of having a store front business, any other suggestions?

kingpin008 May 3, 2009, 04:32 PM As I understand it, you can't just have a FFL for gunshows - you've gotta have a brick and mortar place of business, with set business hours. If not your home, an office, or an actual storefront. If your neighborhood bylaws and zoning won't allow it, pretty much your only hope is to somehow get a variance or forget it.
ScottG1911 May 3, 2009, 04:44 PM why do you want an ffl in the first place? you can buy sell and trade all you want at a show and you aren't technically "dealling" but no matter what, DO NOT buy a gun at the show or trade for one and sell it the same day, then you are dealing firearms. The ATF will sell you a gun and see if you sell it that same day. you have to sell your personal guns, so you cannot buy someones and resell the same day, just doesnt fly with the ATF

pmeisel May 3, 2009, 04:54 PM I know a few "by appointment only" FFL's who rent a small place of business primarily for the address because they cannot operate a business at their home, and use that rented place for appointments. Not sure why that works for them but it seems too.
dogtown tom May 3, 2009, 05:08 PM ATF requires a "licensed premises". You are only allowed to do transactions at two places- your licensed premises and a gun show.
If your city/county/state laws do not allow home based businesses you will not get ATF to approve the FFL application.

You don't have to get a FFL to sale from private collection at gunshows but if you are doing it regularly for profit you certainly need a FFL. You can get a FFL for home, but you have to have zoning to allow it. In NC many rural counties have NO ZONING at all, so you have out of home FFLs. In cities outside of HOAs, people have recieved variances for a home gunshop when they are mainly doing weekend gunshow business. Some people just rent cheap office space, or a place in the county without zoning. This may be really inconvient if you are ordering or doing transfers from people and have to be at that location to recieve things. If you want to make money selling guns I would think you would want to be a FFL, so you can order at wholesale prices.
freakshow10mm May 3, 2009, 05:57 PM If you only intend to sell and gun shows, no FFL is needed, even for profit. It's even asked on the FFL application.

FlaChef May 3, 2009, 09:30 PM one local i know rents a little warehouse in a strip of such in an industrial park. His busineess hours are about 2 hrs on thursdays after he gets off work. Needless to say a good safe is essential in this set up. He does well at the gunshows.
