Wish I could give full credit to the good guy and give him a 2. Thankfully he was not hurt, will most likely not face prosecution, and two bad guys are off of the street (one will be in the ground in a few days).

I can see this being a good shoot if he was inside when it happened (not knowing that state's particular laws), but he was hiding in the shrubbery?

That can be twisted into intent, not defense.

SC law says that if someone is outside your house, but within a certain radius of an entry point (door or window) then its a good shoot. I don't remember the exact distance; 10 or 15 feet or something I think.

EDIT: oops, posted before reading. Not sure if the guy will be charged or not. I'd like to see.

The attempted burglary was the second in a week at the house:. An antique marble dresser, an antique marble-top table, a television and a VCR valued at $1,370 were stolen in an Oct. 9 burglary, a police report said.

The guy you are referring to, Dick Harpootlian, is the former Attorney General who, in his campaign for Governor, declared open season on burglars. But he also would not issue a formal opinion, as Attorney General, so his statement is worth as much as the paper it is not written on. He is a politician and likes to see him name in the paper, nothing more. You can have him.

Harpootlian likes 1911s! I got this from a friend who is an attorney that used to work with Harpootlian years ago when he was a prosecutor. He would go on drug raids with the police, and he always carried a GM. He once offered my friend a spare gun and the opportunity to come along on a raid. My friend went on the raid, but declined the gun and stayed back from the action. (Personally, I wouldn't want to be anywhere near a raid if I was unarmed, but to each his own.)

Harpootlian is a Dem, BTW.
