Captain Ayres actually responded to my email thusly:

Mr. [....],

Thanks for taking the time to contact us with your concerns. You are correct that the possession of magazines marked in the fashion you describe are legal to possess. Trooper Richardson made an inaccurate statement to the news crew filming the story. This was pointed out to him by his fellow officers soon afterward. This also was not a factor in the arrest of the suspect.

The subject in the story was placed under arrest for DWI. The officers obtained additional information that the magazines in question had been stolen from a specific National Guard base in Nebraska. This information has been forwarded to the local prosecutors and it will be their decision whether to file additional charges for possession of stolen property.

actually it was about allegedly STOLEN mags; but the officer thought they were stolen from an army base (for some reason) just because they were marked LE only.

It's pretty clear from the response that they have very little to no evidence of theft, and have major egg on their face for the incident, since their "information" could obviously not be correct.

This is a dead story. The trooper misspoke. His statement carried no weight and had no bearing on the actual legal issues.
