Think the supreme court case will be giant step forward, a few questions though...

would would it do as far as ending the MG ban of '86, allowing us to carry guns out in the open, etc.?

You guys seem to be a lot more tolerant, which is why i think i can see myself spending more time on this board than others...

Regarding Silveira: we just don't know yet.

There's really three questions:

1) Will they hold for an individual right?

My view: yes.

2) How STRONG an individual right?

Harder to say. The 5th Circuit in Emerson found it pretty weak, though indivdual versus collective.

3) Will it get applied to the state? (aka "incorporated")

I think so. Cruikshank is such *ugly* precident otherwise.

Not very likely. Not impossible though.

But let's look on the bright side:

It wouldn't take a very strong individual right to knock out the WORST gun control laws we deal with: the "discretionary" permit systems of Calif, NY, NJ, Mass and others.

And as the gays just proved, losing at the USSC level isn't necessarily a "final disaster". They lost a sodomy case 16 years ago, came back this year and got a full reversal. Could we do likewise? Ohio gunnies lost an important case before that state's supreme court, and it *energized them*. They'll soon have the CCW system they lost before the courts, by getting there via legislation.

Finally, even a worst-case disaster of a USSC decision is too late! There's now 36 states with good carry laws and are otherwise not "gun control hot zones". Those states aren't going to take a sudden turn towards grabberism just because "The Nine Robes In DC" says they can. Those states represent more than 50% of the US population and electoral college/House seats.

We've turned the corner.

JM, I agree with you on everything but that statement. Ohio will not get a reasonable CCW anytime soon. I'd love to be wrong but I know the state well and it's not fixing to happen. We may get CCW, but it will be very very restrictive. Way too many lefties in central power in the big cities to let it slide through legislature. It's been on the floor so many times I've lost count.
