Trouble with Marlin 39 a

Just got a 39 and the lever sticks when closing. It slides back fine then when you start to slide it forward it stops. I can turn it over on its right side then close the lever.It feeds and extracts fine. I have tightened all screws that I could. I can see what is catching it I believe it is the part that kicks empties out. Just wondering if a spring is missing or something. Hoping maybe someone else might have had this problem. Oh yeah the lever dosent stay closed all the way when free.

Is it jamming when fired or when empty, or both?

It shouldn't be the ejector, since the bolt pushes it down when the bolt moves forward. The ejector should be under spring pressure pushing it outward from the wall of the receiver.
It could also be a problem with the cartridge stop assembly, part 24, or something with the cartridge lifter assembly, part 49.
Without seeing the gun, its tough to diagnose these things.

I strongly recommend finding out the actual problem before you start altering anything. What looks like a problem, often isn't the problem, and people do a lot of damaging fixing things that aren't broken.

As for the loose lever, that's a problem with the finger lever spring, part number 42. This is easily seen if you disassemble the receiver halves and look in front of the lever. The spring screw is seen on the bottom of the right receiver section.

Either the springs screw is loose, or the lever spring is weak or worn. You can buy new replacements from several parts houses. If you need to buy a new lever spring, buy a new screw too.

Obtw its jamming when empty or loaded. I can turn the ejector side down and pull back on lever and then work it.

Very unlikely, but check the screw that locks down the ejector when cleaning.

If the opening in the screw head is turned so it isn't under the ejecter there wouldn't be room for the bolt to compress it all the way when the action is cycled.

Got it fixed . Think it was the cartridge spring screw # 32 also fixed lever with # 42. Appreciate the help glad to get it running.I got it for a song they thought it was broke.
