Please advise on the creation of legal defense fund

I am still reviewing various options for taking on VPC for their misuse of my images (http://thehighroad.org/showthread.php?s=&threadid=42691). I am not sure of the best way to set up and administer the legal defense fund -- looking for advice.

Well, setting up a nonprofit is a PITA, and I'm not aware of any pressing reason why you should have to do so.
(The point of a corporation is twofold: first as a mechanism for stock ownership, and secondly as mechanism to protect the owners personal property from lawsuit against the corporate body)
What I'd do, (unless I heard otherwise from a lawyer) is setup a separate bank account in my own name, and keep good records of what goes in and out of that account.
As long as all the money that goes in is used relevant to the reason it was donated, no one can accuse you of fraud.

I will certainly contribute ( it's a twofer, fight VPC and helping the person behind THR PLUS I love your images )
A suggestion. make it so you can do it on-line (credit card, electronic check, paypal { :mad: yeahh I know but they are usefull }) so that more will contribute.
But I'm all for it. The antis love to use the court system ( I refuse to call it a justice system, it ain't) against us, let's use it against them.

There may be copyright/protection issues. You do not provide adequate disclosure concerning the use of your property.
On your image page you have the following instructions:
"Feel free to use them for any pro-RKBA web pages and publications. By-lines or back-links much appreciated but not required. Click on thumbnails to see larger photos. "
VPC is not pro-RKBA. Therefore, if they took that image from the image page, they are clearly not entitled.
I would explore the case law of images used from the internet.
I am assuming all of these pictures are your property.

You might contact Angel Shamaya and the KABA people - they run the Silveira case SCOTUS appeal fund and set it up pretty quickly when the original committee folded.

were i able to practice law yet i would help set up a non-profit
but im a ways away from the bar yet but if any real lawyers helping oleg need some research help i can do it (i have unlimited lexis and westlaw access:) )

Why does it need to be difficult? Why can't the whiteshoe hold it in his trust account to pay expenses when/if they arise? Tilecrawlers do this all the time for deps, private eyes, copy costs and the like in criminal cases.
Don't know about the tax conquences, if any?:confused:

Oleg, Im sure there is a lawyer in your area that will consult for free. Show him the case, get a reatiner amount form him, tell us the numbers and lets rock and roll.
I for one would be happy to contribute legal research also.

Not what I was suggesting - just that since they had done something similar, they might have some knowledge of how to set such a fund up, which is what Oleg was asking for.

I wouldn't even worry about non-profit issues unless your lawyer says otherwise. IOW, follow geekWithA45's advice. This is going to be a business expense, I presume, so just good standard bookkeeping should be all you need.
IMHO, I would first explore your own action....might be fairly simple with the right lawyer doing the first action. Keep in mind that the resultant publicity would probably be to the VPCA's benefit, not yours--we all know how they get publicity for free, and you can bet they'd love to be the victims here, too.
I'm in for $20.00 on the first go-round. But get it going!

This is a very good point. No doubt they will paint us as "the gun lobby" or "a bunch of right wing gun nuts" trying to crush their "grass roots nonviolence movement". Why not just post a "support this site" link here on THR or something similarly low key.

I think the first order of business would be to have an (your) attorney send them a “cease & desist” letter telling they that they are violation the conditions specified on your web site. This would cost very little. If they refuse then you can sue for damages, claiming that your images are primarily sold to gun-rights advocates, and that they’re display of them in an anti-gun context will reduce there appeal to your regular customer base.
You might also be able to claim damage because the way they exhibited your images held you up to ridicule.
In any case, go get them, and I’ll be glad to help support the effort.
