C&R question

Did a search and could not find the answer to my question, also looked through my manual and could not find the answer as well, so hope someone here can help. I am currently holding a C&R license and was talking to my father the other day about getting a couple of closet shotguns. Was going to order through SOG but need some clarity. I am assuming I would order 2 and have them shipped to my FFL. At that point one would get transferred to my father and one to me, is that correct. Or does it only apply to myself? I understand the C&R FFL is not for initiating buisness, but seeing these would go through a normal transfer it leaves me in question. Thanks.

If the shotguns you want are not C&R shotguns, then your license has no bearing on this transaction.
If the FFL is to transfer one of those shotguns to him and not both of them to you, the company you are actually purchasing from needs to be aware of this. They may require 2 separate transactions. Otherwise, the FFL will only transfer them to you as far as I know.

Nate, look in the manual that came with your license, if the firearm is NOT listed there, then it is not C&R eligible. There are some exceptions however, if the firearm can be proven to be over 50 years old, by serial number, it could be considered a C&R eligible firearm. Hope this helps.

Other than get me in the door at SOG, correct? That is what I am getting at (sorry if I wasn't clear in my first post) is the FFL allows me to purchase from gun distributors like SOG, it will require the transfer at my normal FFL but wandering if I can order the same gun for others as long as its transferred in there name by the FFL.

1. If the shotguns are not C&R Eligible, then a distributor from out of state could not ship them directly to you.
2. If SOG is going to ship them to an 01 FFL dealer for transfer and you have to only have your C&R license with them to be a member - I don't see any legal problems with you placing the order - that would be a company policy thing.
3. So long as the person who pays for the gun, who takes possession of the gun, and who fills out the 4473 are all the same person, there is no straw purchase.

Right these would go to my 01 FFL for transfer. I will contact them and see what their policy is. I think they can even do a COD if your 01 is willing to do so. Really the only thing the C&R is doing is getting me through the door. I might add the door is a good one to be able to pass through if you haven't yet. This is from there site.

Thanks for the heads up guys, I want to do this legally of coarse, but if I can get a gun at a fairly decent discount I would like to do so for my father.

Keep in mind, this does not apply to you. You do not have a dealer license, only a collector one. There is a factual and legal difference. What the 03 might get you is the ability to see the price on-line, that is all. The gun will be "sold" to your 01 (or 07, etc) FFL.
When you read rules/regs concering FFL's, where it says "dealer FFL" or such, that excludes a number of types of FFL's, including 03. This is, for example, why 03 types cannot use the USPS to ship otherwise eligible C&R handguns.

A few years ago my son placed an order with RGUNS for a couple of stripped AR lowers. I had him tack on one for me. Our FFL did the transfers (two to him, one to me) with no problem. It doesn't matter whose name it's in until the actual transfer.
