Some of you were interested in knowing the outcome to this (http://www.thehighroad.org/showthread.php?s=&threadid=32242) situation. Well, the magistrate agreed that there was a "mutual misunderstanding" between myself and the officer and ruled on my behalf. All of the violations have been dismissed!

Incredibly, I'm glad this whole thing happened. I have a much better job now as a result, and I'm much happier there. Sometimes things happen and you never know why, and sometimes the reason is revealed to you!

Dev, congrats, I knew this case, if everything, could not survive prelim or was ripe for a motion to dismiss.:cool: Could not say that at the time, hope you understand, but I am MUCH relieved.

The $64 question is, what was the officer's reaction when the cites were dropped?

Are you now going to have somone gunning for you?

Excellent news... glad to hear it.

In my opinion... that fool cop, in his own vehicle, NEVER should have pulled up on you like that in the parking lot, nor should he have followed you in that manner.
If he had genuine concerns about your validity, he should have called for a marked backup unit prior to ever pulling up on you.

Congratulations! When I first read what had happened I figured that maybe a stern lecture was all that was justified, and even THAT was harsh considering the circumstances. The officer was way overboard. I am glad to hear that everything was dismissed.

Congratulations!

The next time you have an abusive officer, call the station and ask for a Leiutenant or Captain to come to the scene. Tell them that you have an abusive officer and you are fearful for your well-being.

Congrats!

Just make sure you thoroughly document and confrontations you have in the future with the "Officer". It pays to be careful.

I had a problem with an "Officer" several years ago. The charges were thrown out and my record cleared. This incident was in a small town. What protected me from retaliation was that Corrections Officers outnumbered the local police 10-1. And of course my fellow CO's knew I had been wronged. :D

So are they going to take away Deputy Fife's lone bullet? I would press the matter with the local PD, both to ensure the incident and the legal resolution is fully documented, that the command staff is full aware of what the officer was doing, and to document and make fully clear that a deadly shooting incident could easily have been the oputcome of the officer's faulty methods.
And pressing the matter in this way lays the foundation for later actions, should the officer in question compound his errors by harassing you in the future.

Now is hte DA drawing up charges against the cop? Are you going to sue him for all the hassle and inconvenience, and losing your job? (Even though you got a better one.)

I would at least get a restraining order against him.

It's good everything worked out for you. That cop was out of line. you should file a formal complaint about this incident.
So the next time he acts like a buffoon it won't be his first time.
